How enforcable are LDK security group's parking charges?

I thought I would post here as there seems to be conflicting advice on the internet.

I recently parked in a car park next to a building I needed to visit, and stupidly, as I was in a rush, didn't notice the sign which details who can and can't park there (which the warden showed me later) . I left my car for five minutes (if that - honest) and came out to find this warden photographing my car.

I said I had only parked here as there was nowhere else I could park (to gain access to the building) but he said it was already issued. The charge is for £90, £60 if paid in 2 weeks and £140 if these are ignored.

I know that there were visible signs and the above info is just inconsequntial words to parking companies as I broke their rules, so do I have any case for appeal? Or should I just pay up the lessser demand of money? Or, as i've read on other sites, is it best to ignore this company - do they have a leg to stand on legally?

Any advice would be appreciated!

    General rule of thumb

    Ticket from the council or police - You will need to deal with it

    Ticket from a private parking company - ignore they dont have an appeal process and I can tell you what they will say

    "DENIED"
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    The only thing they can "legally" claim for is the actual material loss suffered by the land-owner. In this case it's £0.00. So you don't owe them a penny.

    I don't know about that conflicting advice on the internet. There are at least three internet forums that tell you to ignore. I can only imagine that the other side of the story is that one advanced by various private parking companies who are anxious to rake in the money from unsuspecting motorists.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

  • hi thanks for the reassurance...i did wonder if i HAVE to pay seeing as there is a visible sign (other cases on here seem to refer to slipped parking tickets or in Lidl)

    and i'm not sure which site it was on - i googled the company and looked at numerous pieces :)

    Almost every case is like yours. Ignore ANY private parking ticket.

    Related query to ldk ticket. I recently got a ticket from LDK for exceeding my paid ticket time by 10 minutes. I appealed over email giving them my details. Not address but name etc can I now ignore them as they have not replied in over 2 weeks? Or because I gave them my details is it too late?

    Just because they have your name doesn't suddenly make their unenforceable invoice legally enforceable.

    Ignore them. Do not contact them again.

    It's not too late - but this thread you landed on is practically dead (2010!!!). :eek:

    To avoid bumping ancient old forum threads, always click back to the main forum when you find a random old thread by Googling. Read the CURRENT information not an old discussion you stumbled upon.

    It's easy and it's only one click away. You have no idea how many current threads are about these scumbag private parking companies!

    See my signature for where to click (works with any forum, always look for the breadcrumb trail, usually tiny blue writing at the top of a forum page). Click on the right hand end of the run of >links and hey presto you see the forum the ancient thread comes from.

    Then you can read the permanent info 'sticky' thread, currently third from the top 'PPC letters & threats' - get a preview of the letters to ignore - and watch the Watchdog clip on there as well. You never did 'appeal' you know, you just gave a scammer some info they phished for, but if you ignore them from now you'll be fine and can just play snap with each expected letter.

    Even if you’ve written and told them who the driver was, it doesn’t make their actions any less unlawful. It just means that instead of harassing the registered keeper, they can now harass the driver.

    But, they can't actually do anything, for the same reason that a Nigerian e-mail scammer couldn't sue anyone who didn’t pay them.

    (Actually, in the light of recent court cases, the Nigerian e-mail scammer could, if they were mad enough, still try to take a victim to court, but a private parking company (PPC) now can't. I may have to think up a new example.)

    We don’t condone not paying or overstaying in a pay car park. If you do owe the car park owner (CPO) anything, then you ought to write to them, offering this in “full and final settlement”.

    In any event, you ought to advise the CPO that they are "jointly and severally liable" for the actions of their agents, the PPC, and that any further actions by them would be regarded as harassment under the terms of The Protection from Harassment Act 1997. That ought to make the CPO call off the PPC and, hopefully, realise the potential cost of doing business with them.
    The acquisition of wealth is no longer the driving force in my life. :)

    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
