I think we can safely assume you're losing the argument when you resort to sarcasm and vague sweeping statements which have already been put to bed earlier on in the thread.

There aren't any publicly available documents for those cases.

Those case numbers were posted by someone on Consumer Action Group who claims to run a private parking company. When challenged to post the particulars and the transcripts he chickened out, making those case numbers meaningless.

I have no idea what kind of defence or arguments were used in those cases. If you are privy to the transcripts, then share them on this thread and I'd love to discuss them with you.

    Happy reading indeed.

Certainly. How would you like me to post them? They are PDF Files.

Could you strip the text out of the PDFs and paste it into a new post on this thread, or alternatively just post a link to wherever the PDFs are hosted.
  • As these three were touted about a lot at the end of last year I am sure we would all be grateful to take you up on your offer of more examples. I, and others, look forward to seeing them.

Is there any point? How many is enough? 3? 6? 24?

You'll never accept you're wrong. Just one Court transcript proves the tickets are enforceable.

then show everyone the court transcript. I'm sure that will clear all the arguments up :)

3 will be fine for now. Where are they then?

I finally persuaded OH to accompany me on a shopping trip today. We are staying with my in-laws for the weekend, so MIL offered to entertain DS1 & 2 whilst we went to shop for DS1's birthday next weekend.

We drove into Norwich, parked in the TK Maxx/Toys R Us car park, and walked into the city, thinking we'd leave the TK Maxx/Toys R Us shopping until last. We looked for P&D machines and couldn't see any, so assumed it was free as so many retail parks are. We didn't notice any signs, so had a nice afternoon around the city.

We returned to the retail park and did some shopping in TK Maxx, went to put our shopping in the car and noticed an envelope on the windscreen. We were stunned to see a parking charge notice issued by Euro Car Parks. This states that our "vehicle was parked longer than the maximum period allowed" and we are "therefore required to pay the parking charge of £70.00 within 21 days"

We then went looking for signs  The parking bays all faced towards the stores - we found one sign - above head height facing the down one of the aisles - and another facing the direction which you'd see from a parking bay, but obscured by the leaves of a tree (high-up again)

There was nothing on entry to the car park in the way of warnings, and no information in any of the shop windows about parking charges.

We're feeling very hard done by - yes in hindsight we were naive and should have looked harder, but £70 is complete overkill, so I feel inclined to appeal rather than pay.

The ticket has a psuedo-legal statement that says "If this parking charge notice is not paid, the registered keepers details may be requested from the DVLA".

Can anyone give me any advise on Euro Car Parks, the legality of this ticket, the likelihood of them following this up, or the chances of a successful appeal please?

I'd tell them to get lost. Nothing they can do. They might send visitors to ask you to pay -refer them to your solicitor if you have one. They'll soon leave you alone.

They were not hosted anywhere, I had them emailed to me by the car park management company we use; however, I've just uploaded them to a hosting account I have:

Anything could have happened in the County Court, e.g. default judgment etc. Those no.s are meaningless. As are County Court judgments in general terms. They are not binding on any other County Court judges.

If there was an order (which there would be) post it here.

I already have posted them. They're not default judgements, they are cases that have gone to Court, been defended, and the defendant has lost.
