So long as we all stick to forum etiquette then we should all be fine and can all put our points across. Unfortunately I have seen a few posts on this thread that go well beyond the bounds of simply stating an opinion or giving facts.

The above is very true, and makes so much sense. I can't implore everyone enough to think about this before answering other posters.

Any direct insults towards other members will lead to the post being deleted, and referred to the abuse team (as has already happened on this thread).

If anyone feels that a post breaches any of this sites rules, please report this to the abuse team. You can email them at [Removed by Forum Team] or just click the red triangle in the bottom left hand corner of the post (this will open up your email client with the abuse address already filled in). Any discussion of the sites rules should also be sent to the team at the same address (they are the only people that can answer fully about any of the sites rules.....this includes reasons why a post has been deleted)

Once again I'll remind everyone of this forums etiquette (this applies to us all)...................

Please be nice to all MoneySavers. There's no such thing as a stupid question, and even if you disagree courtesy helps.

I have read it. Just because you managed to find three cases where people defended themselves very badly, volunteered to being the driver and did not challenge the courts on the correct basis for redress regarding breach of contract does not mean you are right.

No one has provided any evidence of cases where someone did defend themselves successfully, even though I have asked several times. I am the only person in this forum who has provided anything tangible.

Besides, anyone losing a Court case will moan and whinge about why they lost - blaming the defence is always an easy excuse.

Strangely enough the first post I wrote about this has disappeared , is someone getting sensitive or can they not accept opinions that differ from their own and are based in fact.

Only moderators can remove postings and they do so when someone is rude - therefore you might want to look more closely at your original posting before jumping to further conclusions.

How strongly did he defend the case? And which company was it that took him to court? I'd be interested to see the basis of Asda's (or their agents') claim, as they seem to think they are fines, and refer to them as such in their press releases. In which case, a good defence would see them off straight away.

I've provided an explanation of how breach of contract should be treated in court.

You've provided three court cases where to put it mildly the defendants did a poor job of representing themselves.

I don't have access to court files related to parking. You obviously do. So please go and find an example of a successful prosecution where somebody :-

    - did not volunteer the name of the driver
    - challenged the cost of the invoice as being unreasonable in light of the actual cost of the breach

The fact that you do have access to court cases but refuse to find examples of these cases is very illuminating.

When a PPC thinks they might lose a case through it being well defended it is not unusual for them to fail to attend the hearing. i.e. lose.

As appears to be demonstrated in the first post here:

    http://www.consumeractiongroup.co.uk/forum/parking-traffic-offences/122841-court-case-victory-securi.html

The Defendant was certainly successful in the aforementioned case.

Sorry but I can't see any Court documents or any other form of proof regarding the case discussed on that website. Did you post the correct web address?

The link works fine for me.

What exactly gives you cause to doubt the credibility of its contents?
