  • Good, big turnip has joined the discussion, that should make it good enough for a few more pages.

If people have a contradictory view and keep replying then that may well be the case, maybe you should look up the words 'discussion' and 'forum' before coming to a discussion forum in future.
I've given up trying to get my signature to work with the new rules, if nobody knows what the rules are what hope do we have?

It does amaze me how most drivers ignore the times in bus lanes and just stay out of them all together, not that I'm complaining because it normally means you can overtake most of the traffic at the lights.

I am not surprised people avoid bus lanes completely, I mean do you have time to read a small sign about this when driving? When I was driving a taxi I could use bus lanes, but a quick question about that, if I am driving a licensed hackney taxi in my area, and I go to a place like London for example, would I be able to use the bus lanes there? Not that I am a taxi driver any longer, just curious ;)

They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

This would depend on what the traffic order stipulates. However, the general signage used to indicate a bus lane does not include a variant to say "local taxis only". See diagrams 953 and 958.

If a council wanted to limit it to only local taxis then they would need to seek authorisation from the DfT to use a sign with the words "local taxis only".

Of course it London it would appear that the law is written as if it says 'Taxis and Addison Lee only'.

I've even heard of police pulling people over for driving in a bus lane outside hours of operation, shows you how thick some of the police are these days :D

No, it's not a contravention of criminal law.

We've already said that a bus lane PCN is 'merely' a contravention of a Council Traffic Order. Not criminal at all, Council only run the parking in decriminalised areas.

And we've already said that in fact the owner is responsible (unlike with speeding or red light offences where the driver is responsible and the Police issue the FPN).

But morally I think we all agreed the driver should appeal or pay, and he did the latter.

    :)
    5.-Contravention of traffic regulation order.

    (1) A person who contravenes a traffic regulation order, or who uses a vehicle, or causes or permits a vehicle to be used in contravention of a traffic regulation order, shall be guilty of an offence.

    Criminal law, criminal offence.

No, the words 'decriminalized parking' gives you the clue:

    http://www.worthing.gov.uk/worthings-services/parking/frequentlyaskedquestions/

QUOTE FROM FIRST PARAGRAPH OF TYPICAL COUNCIL FAQS
The Traffic Management Act 2004 part 6 permits Highways Authorities to apply to the Secretary of State to become a Civil Enforcement Area (CEA). Once the CEA application is approved, the power to enforce parking, loading and waiting restrictions, passes from the police to the Highway Authority. Parking offences are no longer classified as a criminal offence as non-endorsable parking offences will be transferred to civil law.

HTH, next time you may be better asking a question on this board if you misunderstand something, ginnersinner. You've quoted an Act that's over 25 years old and has been amended since then - decrim parking being a particularly well-known change. And AFAIK most Council tickets are issued under the TMA2004 - certainly that is the case with most tickets appealed on pepipoo forums. The vast majority of posters there NEVER have to pay their PCNs.

Even this thread you've replied on ended over two months ago, where did you find it?!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
