YIPEE Won ESA Tribunal

Hi,

I have my hearing in 2 day after a long time of waiting and stressing. Wish me look people.

I suffer from severe depression, anxiety and panic attacks with insomnia.

I were just able to gather the evidence and will be taking this in with me would this be fine could someone advise as I read somewhere that you should forward evidence 7 days in advance.

I dont want the case to be adjourned as it has been very long and tiresome and I don't feel I would be able to adjust to any further delay.

Any advice people would the tribunal look at the evidence I take on the day and make a decision??

I shall also tell you the outcome hoping it a good one.

    You need to send any further evidence at least 7 days before the tribunal hearing. This will give the tribunal time to consider it with any other papers.

  • Take any evidence along in any case. Tribunals will normally accept late evidence from unrepresented appellants - albeit sometimes with a slapped wrist. If the DWP send an officer (not always the case), s/he might request an adjournment. It's up to the Tribunal to decide whether or not to give one.
  • I just don't want any more delay the whole process has added alot to my problems, Im worried about what is going to happen on the day itself and im unsure if I would be able to cope with a decision or even a no decision.
  • Whilst fully understanding your concerns, the difficulty is that if you don't put forward evidence, the Tribunal can't consider it. The Tribunal will then come to a decision based on the documentation before it and any oral evidence you give at the hearing. Only you (and/or a professional advisor) are in a position to judge whether the additional evidence might make a difference.

    I appreciate this may *appear* to add to the stress. My advice is still to put the evidence forward, apologise for the delay and if an adjournment is suggested, ask for that NOT to happen as it might excerbate your state of health. But, as stated earlier, it is up to the Tribunal to decide whether an adjournment should take place.

    I'm on early stages of appeal for IB and got ESA medical in 2 weeks so i know the stress you have been under. I hope everything goes well for you
  • I didnt submit any new evidence when i had my tribunal as the tests i was having done came after it. I won mine because i was able to answer there questions and they could see how i was. I would take the evidence with you and as they did ask me if i had any to give them. It is worth a try. Dont worry too much it is straight forward and not as scary as you think it is. Good luck.

    Are you taking anyone with you for support?

    I got very upset at my DLA Tribunal but thankfully I had a friend from the National Autistic Society, my Occupational Therapist & my mum with me who helped me calm down.

    Hi, I just wanted to say good luck!

    Unfortunately I had to give up on my appeal for ESA as the stress was too much.
    Now having to claim JSA even though my GP has hit the roof and I know I will never be fit enough to work.
    I was also turned down for DLA so that went the same way!

    I am taking a friend hopefully with me tomorrow for support and my REPRENSENTATIVE is making a written submission for me stating the ground of appeal and the points,
