Bailiff wants ME to feel sorry for him!!!

    On the other hand if he has such a backlog of work then if you ignore him surely he will have to busy himself with his backlog rather than expend the time chasing someone who is ignoring him, as for the visit to your house, I would cancel it if I was you, just opening the door to greet him is considered "an invitation to enter" and an open ended one at that. Tell him you'll meet him in the cafe down the road, you could even get him to wear a pink carnation for identification, better still have him carry a copy of "I'm gay and I'm proud" or some such magazine, when you meet him slide the cash under the table in a brown envelope, when he opens it make a big issue of him checking it in public and look nervously at the people on tables around you, once you have your receipt, stand up and shout out "this is the last time I'm paying you" and hurry out the door looking over your shoulder with the most worried look on your face you can muster.:rotfl: :rotfl: :rotfl:

    This is the critical wording from the site that @cat so helpfully sought out and posted by the way.

    Once in the house the bailiff has the right to go into all rooms and can break open any locked door or cupboard inside your house. If the bailiff gains peaceful entry s/he has the right to call again and enter even without your permission, i.e. s/he can break in and remove your goods.

    So do not agree to this visitation it is for the purpose of gaining lawful right to re-enter your property to seek to seize goods for the disputed amount and will almost certainly be followed by a second visit once you have paid what you agree you owe. You will most likely return home to see your front door boarded up "In order to secure it after his visit" this will undoubtedly be a traumatic event for you and once they have sold your goods on there is little you can do to regain them even if there are legal findings against the bailiff, he does have a duty to ensure the goods or chattels belong to you but as long as he is acting in good faith, ie he believes the debt to be a valid one there is unlikely to be any come back on him.

    Don't allow the visitation.

    Oh my God!!!!!! Having watched the BBC1 programme last night I now feel totally sick(& VERY VERY stupid for allowing myself to get into this mess) regarding tomorrows visit. I called our overworked little flower to try to arrange to met him somewhere else, only thing he could come up with was that I could meet him in LIVERPOOL on Friday between 8:30-11:45!! OR Wigan this afternoon. We live in M/C so thats not much use. DH is out very early tomorrow- (departmental y9 trip) so have decided to lock the gate and just wait on the path for the visit(so that he has to stay onthe pavement) is this a good idea? I have a large chain with a strong padlock on it(from when DH was a student used it for his bike) which works have just tried it and it works. Will be SO glad when this is all over. Also had an initial reply from MP who has written to the firm and is awaiting their response. I KNOW without any doubt that they did NOT call on the dates they have claimed to have called. I accept I have to pay what I owe, its my fault and I have to sort it. BUT I'll be damm*d if i'm im going to pay inflated charges for visits that didnt happen. Feel like giving him a cat litter shower!!!!!

    another trick is to keep the door locked and only talk to him through the letter box.

    What I don't understand is why they won't just let you pay a cheque or pay in at their office? Why do they HAVE to come round?

    Dont know. Have tried. They will only accept cash or a debit card. I have over half the ammount and was fully prepared to give debit card details to finish the account in two weeks hence. You'd almost think that they were trying to keep bumping the charges up wouldn't you?? BUT surely our brave upstanding "court officials"" wouldn't do THAT would they?????

    They might be more co-operative after last night's telly programme! I might be tempted to pay amount into bank and pay by debit card and tell them no visits or visit fees required.
