Pleased exam went well...As for the response, he is a slime ball! I think he is being exceedingly arrogant and rude aside from anything else. Still, he has not denied that he owes you the lessons which is a good thing so you have some evidence that this is in fact true (not doubting you, it's just if you take it to court he might just produce a booking record saying you had all you were entitled to. Because hi emails don't deny it, this won't be so easy!) I think CAB advice (free half hour I think?) and contact the DSA.
Did he send the terms and conditions and what did they say?

I also have screen copies of his website to prove that it doesn't say "terms and conditions available on request" anywhere on the site and when I joined all I was given was a time card that had this on it

So to be honest, any average person would consider this to be his terms and conditions. I've had a look at the ADI terms and conditions and nowhere does it say about sell by date for paid lessons. As it's money owed, would this be counted under the 6 years credit act type thing? I could've gone all out and told him why I stopped having lessons with him, but I don't think he would've liked that either... of how many times he interupted to go to the toilet, or quickly pick something up. and the more lessons I had, the more shy of the hour they became. But I'm trying to keep this a business transaction rather than a slanging match. Should be interesting....
I haven't recieved his terms and conditions yet as he only replied last night, and I'm betting that he's going to amend them to cover his own ar*e. Does it make a difference that not only was I not given a copy at the beginning, and because they're not offered from the website it would deem them not readily available and thus uninforceable in this case? Or am I clutching straws on that one.TSB: £4900

i'd say that about wraps it up, especially the T&C. Nowhere does it say additional T&C's exist. ...do you have a receipt for the block payment? all the card shows is the prices and the lessons you have had (I'm not sure what the £ column means though to be honest! I would go see the CAB, and just run it all past them, then write a letter, stating the facts, I would say as no terms and conditions further implied on the card you have a good case. Send it recorded delivery, stating he has 14 days in which to issue a refund, or you will proceed with the small claims action, which the CAB think you have a good chance of succeeding in, and that will incur him further costs.

Thats ok, the £ column is basically (how many hours I've had) / (how many I have remaining)

I'll make an appointment or drop in to the CAB it'll make a nice distraction from more revision lol. I think I've got a strong case too, so hopefully CAB will agree. As I say, I've done the whole bank charges thing, so luckily it's pretty similar with the letter before action thing and going through MCOL.TSB: £4900

How much do you intend to ask for back? It's not going to be easy to put a figure on it as was said earlier so might be worth working othat out before you go to CAB. I can't imagine you will want to be awarded the remaining lessons!Good Enough Club member number 27(2) AND I got me a stalkee!

Lol, yeah I can't see myself driving with him now, as he wants nothing to do with me... I feel so unloved lol well you can't say I didn't ask haha. I just want the remaining money, which is £85.50 I'm not a greedy person, I just don't like it when people try to take others for a ride.TSB: £4900
