As I'm already booked up with lessons with another company up until my test, this is why I thought I'd ask him to put the funds towards the pass plus course he does, and then I'd top up the rest of the fee.
Basically he seems to be refusing the pass plus offer made, and I still haven't seen these terms and conditions he speaks of, and to be honest, I don't think I can trust him to not put an extra clause in to cover himself if I ask for a copy.TSB: £4900

Ok another update, after talking it over with a few people. I've decided to attempt a refund, no harm in trying is there.
I've replied to his email basically asking for a copy of his so called terms and conditions, and saying that as he has chosen not to grant me owed lessons towards the pass plus that I am forced to ask for a refund. If he chooses to ignore or refuse this request, I've decided to make a complaint against him with the DSA and ADITSB: £4900

I think this is the correct course of action! If there is nothing about a "use by" date on the web site, then you are owed either 4.5 hours of lessons, or a refund.
Don't waffle too much in your letter. Be direct and to the point, but polite.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

I'm waiting for a reply from him still. but I've got my degree exams for the next two week, so I will be waiting to deal with it then as I'm under enough stress. Luckily one of my uni collegues dad is a solicitor, so I'm hoping he can advise me a little bit.
I've written an email to the ADI (their phone line keeps saying it's busy) explaining the whole situation and asking them to advise. Hopefully I'll get a reply this month, would've waited to put it in writing and posted it, but I just wanted to get it off my chest and sent! lol.
From previous experience of law and bank charges (not a lot of knowledge but it may help) I'm thinking if he refuses to refund, maybe I could use Money Claim online, or is that too big for this situation? I've also gone through 9 months of the stressful complaints procedure with Npower before, so hoping it'll be along those line.

No wait, we would prefer that possibly OP would be better off not driving in the end, if her lessons are anything to go by.0 -
Any help on getting my money back will be greatfully appreciated.
I'm currently a lot happier with the company I'm driving with now, and I'd prefer to pay her any money I get back, rather than having to deal with my old instructor again (other names now come to mind, but I must refrain lol)
