Nothing has changed - I wanted to know if I was right in accepting the repair & clean or LEGALLY could I have demanded a refund.
the time to have asked this question would have been BEFORE you accepted the remedy that was offered and ACCEPTED, not after.Yes we've had the day now & it won't be worn again however I could recoup the costs by selling it anyway but if I am within my rights to demand a refund why shouldn't I?

You're right moutainofdebt, before I took the dress back would have been the right time to ask - however it was an item on Martins weekly email that triggered my question - hence posing the question on here after I had returned to the shop.
I accpted their offer but they have now had the dress two weeks & I've heard nothing - I feel they've had a reasonable amount of time to repair & clean the dress.
If it's been done when I phone them then that will be the end of the story. I didn't want to be seen as a person who has had the use out of it and now wants a refund - infact I wasn't going to return it at all, it was just other people telling me I should. When I thought about it, if it was any other dress that cost £150 that was defective after 1 wear I would return it for a refund. The fact that this is a bridesmaid dress has gone against me.

Simple fact is that it wasn't 'Fit for Purpose', that it would be worn all day for an event. As many of us on the wedding board hunt for 'preloved' dresses, she also lost out on the chance to make some of her money back by reselling the dress. I wore an outfit from Moonsoon that cost £145 as a guest at a wedding, but by the end of the evening the seams were starting to come away, I took it back and asked for a refund as 'Not Fit for Purpose' and they refunded the full amount without issue even though it had been used for the event I bought it for. MSE exsists to make sure the consumer knows their rights, so enough of the silly comments and focus on that!:rotfl:Ahahah got my signature removed for claiming MSE thought it was too boring :rotfl:0

How has the OP lost out ? Presumably the dress has been / is being repaired so she will have the opportunity to sell it on after it has come back from the shop, and won't even have to have it cleaned as it is being cleaned as part of the arrangement.MSE exsists to make sure the consumer knows their rights, so enough of the silly comments and focus on that!

Currently the OP doesn't have the dress back, so she was asking if she could have asked for a refund. ETA: I meant she lost out because selling second hand will not get her as much as a full refund. Hope that makes my post a little clearer?
