  • Excellent! Just got a reply from the seller of the replicas. He wants to know the buyer's ID, as he's had someone sending him abusive emails very recently. He has also offered to help me prevent this guy from ripping me off.

    I don't understand this person, unless he is trying to pull a fast one, like you said. I clearly stated on the auction that it wasn't an original. Also, nobody has left negative feedback on the items I've sold. Can you let me know his ebay user ID. I recently reported somebody to ebay for abusing me via email. I wonder if its the same person.     Selling "fakes" via ebay is supposedly against Ebay rules in itself.

    Considering the item, it would be hard for Ebay to pull it as a fake, as such. The seller claims that it is exactly like the genuine item, but is not the genuine item. The item he is selling does not carry any trade mark, therefore is not infringing on any copyright. There are many companies out there that sell this particular item, however, one is more popular than the others. I sold a genuine one (as in it is made by the most popular company), whereas the seller sold one that looks like the genuine one, but is not. It's like selling a pair of jeans saying that they are like Levi jeans, but are not Levi jeans. They don't pretend to be Levis and don't infringe on trade marks or copyright. See?

    Hi. I think you are right in pulling out of the sale even if it does mean getting negative feedback.

    If you read January Ember's thread here you will understand why I'm saying this. It looks like more and more people are into scamming innocent sellers who just want to earn a few extra pounds. How can they be so dishonest??

    Yep, I read that thread. I might actually go ahead with the sale now, in light of the fact that the seller of the replica is willing to help me prove that any accusations of me sending the buyer a replica are unfounded. If my buyer tries it and sends back the replica, the seller of the replica will ID it as being the one he sold the buyer. I'm also taking pics of the box, serial number, etc alongside the receipt I still have.

  • I think that is a bad idea, you are pinning your hopes on the replica seller backing you up, he may well say he will and he may well want to chase up an abusive buyer, but you have no guarantee that push come to shove you will get the backup you need.

    The replica buyer may well not be too keen to draw attention to himself any more than is necessary, eBay can be funny about sellers what is okay for them to turn a blind eye to one day isn't the next, life is too short and I am sure you will find another buyer, so why take the risk, everyone on eBay will end up with with negative feedback at some point, regardless of how good they are, so don't worry about it.

    Well, glad to see that only one person thinks I'm being paranoid! OK, I'm going to pull out of the sale and refund the buyer. I did email Ebay but have had no reply. The buyer's on holiday at the moment, so it will have to wait until the second week of October.

    If they're away you could refund the payment, open an NPB and provided they don't repond within 7 days they can't leave a neg, they can only leave a comment. Just a thought.

    I would have pulled out as well. Remember that paypal usually favours the buyer and I can easily see them overlooking all the evidence you could offer as it would take too much effort for them to go through it.
