Hi Guys
I am severely enraged with Wickes builders merchants.
I placed an order for some lap fencing on Wednesday 5th May and was told that i would be contacted to arrange a delivery time on the Saturday as i paid the extra charge for this.
I then received a phone call the next day to advise me that the goods i ordered were out of stock, they had no idea when they would be back in and they would contact me when they arrived in to arrange a delivery date/time.
Needless to say this was not acceptable so i phoned the store to cancel who told me i had to contact customer services, which i did.
Everything went fine until i asked her how long the refund would take and she told me that it would take up to 30 days. At that pint my blood started boiling over.
I told her this was unacceptable and that i wanted my money back right away as i hadn't actually received any goods and i needed the money to go elsewhere.
She then became ratty and said this by law, that by law etc etc so i asked for their complaints department and she gave me an email address.
I am not holding up much hope that i will hear from them however, is it true that i have to wait 30 days to get my money back, even though i haven't received any goods and the fault is theirs with the stock.

I figure DSRs cover buyers pretty much in any instance. Ebay seems to confirm this online, stating that BIN buyers can return within 7 days of receipt with some exceptions ie custom made. Also, as in the case of an item I purchased, the seller's returns policy is "none offered", which I gather I can ignore: pages.ebay.co.uk/safetycentre/keepingebaysafeandbuildingtrust/knowyourrights.html#whatiftheseller
However, I have since browsed other listings that state returns are not accepted. Does this mean the seller can get a slapped hand for posting misleading info, and definitely cannot uphold their policy??
I called ebay and asked: "do DSRs cover all BIN transactions (bar the exceptions) and are buyers entitled to a full refund?" YES
"Can sellers post "none offered" returns policies?" YES
"Wait, what?" It's between you and seller to discuss, you can open a returns case and resolve it.
I'm confused!! I want to buy something that seems to be listed only with "no returns" policies but is that even valid??!
It's an item of clothing, so what if it doesn't fit? I don't want to be stuck with a £20 item (I can't afford to just let that go down the pan).
Anyone else out there know any better? Particularly regarding ebay. Please and thanks!0 -
I wonder if anyone can help me. I have a car seat for my daughter that I bought in October 2009. On Sunday 8 May, the harness on the seat broke whilst my daughter was seated in it. I returned it to Mamas and Papas, who (without asking what I would like to do) have sent me back the same car seat and simply repaired it. All the advice that is given states that you should not use repaired car seats or second hand ones because they may not be safe in an accident so I am loathe to let my daughter use it. Mamas and Papas have tried to assure me that they wouldn't send it back if it wasn't repaired to a satisfactory standard and that I shouldn't have any problems going forward. Legally am I entitled to ask for a new one or a refund? Many thanks.0

Hi wonder if anyone knows the answer to this - bought a mobile phone off Ebay and the seller accidentally sent 2 separately. I have repeatedly - about 6 times emailed him and asked him to either arrange collection or send me a prepaid label to post the item back to him. Neither have happened he keeps saying he will and then I hear nothing and then I email him again - this has been going on for about 8 weeks now. Somebody told me that if you give the seller 3 months notice and he doesn't do anything you can either keep the goods or sell them - does anyone know if this is right?

on the 4th of april i purchased a fairing and set of mirrors for a motorbike. I was sold these items over the phone and was assured that they were in perfect condition. When i received the parcel i found the fairing was broken and was in no better condition than the one i had. I telephoned the firm back and asked them to collect the parcel, they told me i had to speak to the owner who was nver around when i called. After 2 weeks of trying i finally got him to send out a company to collect the parcel, unfortunately on the day they came out we were out at a family funeral, i called him again to rearrange collection and after getting an ear full from him as to how much this would cost him they finally collected it. I stupidly assumed that the money (£91.66) would be refunded to my account! I had to call them last week to request this and on checking my account today they have put £60 (£31.66 short) into the account. I have phoned them to be told that the manager instructed one of his employees to transfer £60 because of 2 failed collections. What are my rights??? HELP please!0

I bought a few items on the American Apparel website on April 1st. I received an email saying all my items where going to be delivered except one, which would be sent later due to not being in stock. I received all the items except the 1 that was coming later, my receipt with this parcel also then confirmed that 1 item would be sent later. It got to May and I sent a message through their website (I couldn't find a decent email address) asking when it would arrive. I got this response
"Dear Elizabeth,
Thank you for taking the time to email us with regard to your order, we greatly appreciate you taking the time to do so and apologise for the any concern caused by the need to contact us.
We have been trying to fulfil all the back ordered garments by sourcing the items from across our european stores but unfortunately we are now completely out of stock on this particular item and we won't be re-stocking. As you may be aware this was a very large sale on a 'while stocks last' basis.
I apologise again for the delay in contacting you regarding this matter and for any inconvenience caused by this. Best Wishes"
I then sent a reply saying that there was no statement in their response has to how they would rectify this. No reply. I tried to phone but no answer, I sent another message through their website and nothing.
I have not had any communication from then or my money back. What is my next step?

Your next step is to post a new thread in the board that you replied to this one on, read the post above yours, #219, you have replied to a thread that says in it's heading, "( DO NOT ASK CONSUMER QUESTIONS HERE).
