    :o all I said was I've heard others have been offered free delivery on a future order, please could I have free delivery on mine seeing as I'm not getting the reduced rate delivery because I had a car seat on my order, and they said I had to pay the full price and then once I have it I'm to ring back and they'll refund it for me :o

    I think they meant to say that my t shirts have been despatched, but the car seat is still showing as an outstanding order so its come through accidentally on the same email, I dont think I am really a Chosen One :o

    Can someone help me, I dont know what to do or where I stand!

    I had thr cancellation email, then the despatch email, and then today I had another email saying they've refunded the money onto my card.

    But as I understood it, once they email to confirm despatch and take the money, thats the contract formed so I can fight this somehow, am I right?

    Can somebody at least point me in the direction of the right board to direct my question to if needs be.

    Why not just accept that the company made a mistake. They were more honest than a lot of companies & after the "we don't have any in stock" line they sent out another email stating it was actually a pricing error.
    You win some you lose some. This was a lost one.

    I thought that once they took the money (actually taken it rather than the normal hold on it) then they have to supply it? I once booked a holiday and they rang up the following day, after the payment had been taken, to advise me the accommodation was no longer available but they could downgrade my accommodation for a reduced price. After being told by someone that a contract was formed as soon as the payment was taken, I refused their downgrade offer and they offered upgraded accommodation free of charge. HTHs

    Only if you actually recieve the goods in hand though, until you actually have them, then the contact is formed.

    Just for ref to others unless you have the goods in hand, no contract is formed even if you have paid. I know this because i paid for something at Argos that was a glitch went to collection point where they refused to give it me, and just refunded. After looking into this they where allowed to do this :money:

    Thank you guys, it seems to be one of those areas nobody is ever clear on! Maybe it would be a good idea for a sticky or something to save confusion!!

    as much as its good to clear these things up, honestly, is it really worth the hassle to go down the lines of contesting it?!

    a quote from the second e-mail:
    Our full terms and conditions can be found on our website and confirm that Mothercare has the right to withdraw our acceptance of an order where our website offer relates to goods that have been priced below that which we intended. The item has therefore been cancelled from your order and you have not been charged.

    I think thats enough said!
