    I didnt know this, but Paypal dont care what item I get, for 2 reasons:

    1. I open an Item Not Received case - they then see I receive something

    2. Non-ebay items are not covered by the "item not as desribed" policy

    The scammer has it well planned out!

    No you wouldn't.

    Paypal would have asked your card issue for money, the card issue would have processed the transaction.

    Ergo they did exactly what Paypal asked them to do, which is fund the account.

    The fact that Paypal then sent the money onwards is of no consequence to your card issuer whatsoever and they would not have refunded the money - the two transactions are completely separate.

    BTW: The CCA is not "insurance" either.

    Only if people don't understand the paypal rules. There is complete protection even off ebay even for item significantly not as described claims.

    However the paypal payment must state that it was sent for goods and not sent as a gift.

    Login to paypal, dispute the transaction and tick the 'Item not received' box.

    and complete the dispute.

    You should win unless the seller cannot provide a tracking number for the goods.

    Cheers guys, some helpful info in here :)

    I will file the dispute as soon as I can, I cant open one yet though, has to be 7 days or so I read since transaction

    He can rpovide them with a tracking number of the faulty phone, I have been told to just refuse to sign or "not" be in to collect, but how would this stand with Paypal, could they see I refused delivery? Or would they just track it back to going back to sender?
