cash converters lost my iphone

hi i recently put my iphone into cash converters on buy back for 28 days.

I went there yesterday and the people that work there have given my iphone to another customer as they read the reference numbers wrong .
Now cash converters have left a message with the other customer but he is on hoilday in morrocco until monday they say he is a nice gentlemen and will return my iphone but I would like to know what if he doesnt what rights have I got against cash converters in the event he fails to return it.

Cash converters have said that if he doesnt they will replace my iphone with a second hand one from there shop , but forgive me I dont think that is right as my iphone is practically brand new and has vital information held on it that I can not replace

    do they still have the other persons Iphone ??

    they should replace your phone with one of equivalent value/age , can you prove how long you had the phone and that you have paid for Apps/music on the phone (maybe from itunes purchases) ??

    What sort of small print is there on whatever contract/invoice they give you when you pawn your goods?

    Never had to pawn my things for money so I'm not sure how it works.
  • the other person doesnt even have a iphone so he has left the store either not knowing or intensionally knowing that he had something that wasnt his the reason I know this is because they tried to give me things instead and when i said this doesnt belong to me thats when the mistake was made clear but what is getting me is there is a obvious difference between and iphone and a camcorder and ipod which are his so why didnt he say something ???????

    as for what is on the phone its not so much the apps but personal details like bank numbers and things important contacts that i cannot afford to lose and so forth

    Yet you pawned it without backing up the contacts and deleting the bank account details?

    Okay maybe the contact list isn't a massive risk but handing over what is essentially a little computer overflowing with personal data and sensitive banking information?

    and as for the other statment believe it or not but when you give a business something you would expect them to look after your property the phone wasnt charged and it only held numbers not names I am not that stupid

    If you are using Cash Converters you cannot afford an iPhone.

    You should be using some tatty Nokia brick instead of spending money you don't have.

    To give your phone to a pawnshop whilst it contains all your personal details is Unquestionably stupid.
