You can't have it both ways, either the transaction was authorised in which case you are due no refund, or else it was used fraudulently in which case action needs to be taken by you to recover funds. I do not believe it possible to sue an 8 year old, however take them to the police station (pre warn the youth officer) and frighten them a bit with their talk they use about taking things from other people.
I'm sorry you don't feel that you are getting good advice on here but we cna only tell you what the rules are. Take it out his pocket money so that he has paid it back, I dont think you will get your money back from your CC company or from nintendo.0

No one can help you because you were negligent with your card. If you have bought stuff when your kid was next to you so he's seen how you do it and he's a thief which is what it amounts to - then you should have been more careful.
If he asked you if he could have a game and you said no then he just did the electronic version of raiding your purse! He needs to know how potentially serious what he did was - I suggest grounding him for a month!
Don't try the "Aw but he's only 8 years old" on me either - I've taught Juniors for the last 20 years so I'm fully aware of what 8 year olds are capable of.0 -

I lock the cards that aren't in my purse away, yes!! And my purse with the card I do use is kept in my bag, in a high place so that my son can't reach it. Basic security. Sorry you don't feel the advice is helpful but i'm struggling to empathise because I just don't leave my bag vulnerable. Instead of feeling hard done by, perhaps consider employing some of the techniques suggested to improve security in future?Good Enough Club member number 27(2) AND I got me a stalkee!

The verified by visa seems a bit of a joke to me-I can never remember my password but it's easy to reset and you only need the card and the cardholder's dob so he could have got through that eaily to.0

The password will be sent to the registered e-mail address so some basic internet / e-mail security should prevent access in this case.0

Isn't that EXACTLY what has happened.
Your 8yr old son did STEAL it from you.
You either need to report the theft & fraudulent use of your card to the Police, or take it on the chin and accept what has happened.
Bear in mind you were negligible by leaving the card unsecured whilst not in your possession.

You need to speak to your son and explain what he has done is wrong and why he must never use your card. Use it as a learning opportunity and nip it in the bud, in case he starts stealing cash or taking other peoples things.
I've got my credit card details stored on our xbox as I paid for my sons Live memberships, but they have been warned if they make any other transactions on the card, they will be in serious trouble! The card has been on for about 18 months now and they've never bought anything online with it.Here I go again on my own....0 -
