Unauthorised transactions

I really hope someone can help me.
My son is 8, and was bought a Nintendo DSi last year by his grandma. Today I notice £45 in £9 transactions has left my bank account, somehow he has managed to buy 5 games and download them to his DSi using my Visa debit card.
I figured since I never authorised the transactions it wouldnt' be too hard to get my money back, how wrong was I?
Nintendo told me in no uncertain terms they where non refundable and it was my own fault. The Visa chargeback people also turned round and told me again that it was my fault and that I should have kept my card safe. Well i'm sorry, but my card is safe, its in my purse, in my bag, in my house, as safe as it can be. My son shares my house obviously, I wouldn't think that because he managed to get hold of it I would become liable for something I never authorised. The only thing the woman on the phone suggested was to prosecute my son.
Surely I have rights??

I really don't mean to sound harsh, but you don't have a leg to stand on. You are both legally responsible for your cards, and you son, and should know what they are doing at all times. Be that watching the Disney channel or doing a spot of card fraud.0

lol your 8 year old bought some games for his ds, i never bought stuff using my parents card when i was 8, its your card so your responsible for it, this might have an interesting outcome0

Yes well Im quite aware im responsible for my card, had it been anyone else though that had used it I would have been able to challenge it, if someone had been invited into my house and then took it for example.
For the record I don't think hes thought "oh well I think i'll spend £45 on games", I don't think until it all came to light that he even realised what he had done. He thought he just had points on his DSi. Doesnt' make it right, but he hasn't done it maliciously.0 -
But he must have had to put the card number in at some point!! He can't have just gone online and "spent" points! I'm afraid even an 8 year old knows that nintendo points don't come off a debit card...krazeybird wrote: »

Err, well how many people lock their card away when they're in their own home?? I doubt very many.
If someone stole it out my bag whilst I was out I doubt id get the same criticism about not keeping it safe, and funnily enough I would be able to challenge it.
Seems nobody wants to give me any friendly advice anyway eh.0 -

TBH I can make purchases online and then claim my little brother did it and that I never authorised them please can I have my money back, can you see how ridiculous it sounds.
You just need to learn next time to keep your stuff to yourself if your 8 year old son is doing this now imagine what he will be doing when he grows up.0 -
Is it one of those automated things like with itunes? My cc details were on there and the kids downloaded stuff without realising it was being charged to my card
It was a real struggle to remove my card details from there too
