you should have put on the claim form that you wanted the money to come back directly to you, not your agent. That way, you would have been refunded the entire amount.
However the question as to whether its legal for the agent to take their booking fee or not - i'm not 100% sure, however i know for certain that my agency wouldn't do this. Anything refunded back to us would be refunded back to the client!.

Hi, thanks for your reply. I did get the refund direct from the CAA, but it was only for £240 as airflights.co.uk had only actually paid Kiss airlines a deposit for the flights I'd booked, although they had taken full payment from me at the time of booking. Keeping customers money in their account for as long as possible and making interest on it is probably another money making scheme of theirs.
Although airflights had the rest of my money from the time I booked the flights on the 10th May 2010 they said they were unable to release it for legal reasons as Kiss airlines insolvency agent had said legally that money was theirs.
Airflights.co.uk have written about this on their webpage under the FAQ section. Oops I'm new so i've just found out I cant post the link I'd typed, so had to delete it lol.
Apparently they only actually passed peoples claim forms on to the CAA once a settlement had been reached with the CAA, in my case despite me completing the claim form in August they only passed it to the CAA in December!
I think a lot more people are going to find theirselves in a similar situation. Anyone who booked their holidays/flights more than 10 weeks in advance, through an agent that charges the full amount at the time of booking and then only passes the full amount to the airlines, are going to end up getting their money back from 2 places, minus any charges the booking agent decides to take! I hope I've explained it clearly enough because I've a job to get my own head round it, never mind type about it lol.

Still awaiting a refund for the hotel part of the holiday as we were unable to rebook.
