thanks for all the replies and support

I thought I had sent an update about a week ago but for some reason its not on here

Basically the council served a re-posession notice on my flat even tho they knew the entire story

I got to talk to the woman who actually sent it and she said "well thats the procedure"

    !!!!!!!!

a week ago the housing benefit mysteriously back dated the claim which is what I have been asking them to do all along

I appreciate all the theories that there is no malevolence in this

but I do believe completely and totally that if I had broken down and paid that £300 from my own pocket NONE of them would have said "no thats not necessary we'll sort it out" They would have just taken my money

and you have to wonder what would have happened to the £300 benefit money if I'd done that...

no way of proving it unless you work there and know whats going on and catch someone at it

lets face it - its not as if it has never happened before

and people like me have to go through months of unbearable stress just because one or two people are trying to get themselves a £300 back hander

    *shakes head*

Some people really don't have a clue and shouldn't post nonsense like the above.
    *SIGH*

I doubt very much if anyone was hoping/trying to steal any money from you or the benefit system.
  • Please write to your local MP https://www.writetothem.com I have done this before when housing benefit repeadedly messed my claim up (4 times they made the same error and 3 times i was promised it wouldn't happen again) Your local MP will get things moving very quickly for you. You'll be surprised.

Hope that helps and please try to stay positive. They are aware they have made an error/delay. It's not the first time and it won't be the last.

    Chin up :-)

I went off sickness benefit onto JSA without any gap whatsoever

Housing Benefit wrote and asked me to inform them of my circumstances

I waited for JSA to send me information to show Housing Benefit

    no information came

I had 5 weeks with no money

JSA was telling me I was claiming Sickness benefit and sickness was telling me I was claiming JSA

Finally after hours on the telephone to the incredibly rude and aggressive JSA staff in Glasgow who gave attitude for no reason and were totally incompetent and unhelpful the entire 5 weeks of the ordeal JSA understood that I was claiming JSA and started to give me money

Housing Benefit have now contacted me and saif there was a gap in my claim and I oew £240 in rent arrears

I have called them and been into the office to explain that there was no gap in my claim

their explanaition for this demand for £240 is because I didnt notify them

I have explained to every single person I can talk to that there was a 5 week period of total confusion and I didnt have documents to send them

every time I asked JSA to tell Housing benefit that I was on JSA they refused - they kept saying I was still on sickness benefit - it all just went round and round and no-one could have cared less

I am confident that Housing benefit are fully aware of what they are doing

they know there was no gap in my claim and this ploy to pin the blame on me for not sending forms is a total smoke screen

Anyone can see that there was no gap in my claim and I have documents to prove it

to say I owe them £240 for JSA incompetence is deliberate manipulation of the facts

They have deliberately sent me from pillar to post and they know none of my running around is going to change their decision

If I am evicted from my council flat I will kill myself - its as simple as that - it has taken me 20 years to get this flat - I'm 52 and I have no job and nowhere to go

I feel I'm totally at the mercy of people who are deliberately planning to get me out of the flat by falsely causing arrears that they know I cant pay

could citizen's advice help me? what are the legal rights of someone continually claiming benefit? Surely I am entitled to get that benefit?

I need someone to fight my corner - they know they have got me where they want me

If you are now on claiming JSA this means you are classed as fit and well to look for work.

When your claim was stopped so was your housing benefit. when you get onto JSA they will hopefully set up a new claim for housing benefit.

As its a new JSA claim it may take more than 5 weeks to process and JSA will inform HB as soon as your in receipt of JSA.

As there was some confusion over benefits, your full rent became due.

You must of recieved a letter saying you was changing benefits, or a claim was stopped!! Yes you do own rent arrears, as it sounds like no body informed HB. NEVER rely on anyone to speak for you!! If your circumstances change, then its up to you to inform to right people.

As for killing yourself, thats up to you what you decide. But as you say you want to keep your flat, so be more stronger and start looking for a job as soon as possible. No one is going to help you only you can do this.

If you do kill yourself your council flat will be given to someone else.so what you have now seems pointless if you have a weak mind.

There is always a solution to problems in this life.
