if I'm evicted I will kill myself

I went off sickness benefit onto JSA without any gap whatsoever

Housing Benefit wrote and asked me to inform them of my circumstances

I waited for JSA to send me information to show Housing Benefit

no information came

I had 5 weeks with no money

JSA was telling me I was claiming Sickness benefit and sickness was telling me I was claiming JSA

Finally after hours on the telephone to the incredibly rude and aggressive JSA staff in Glasgow who gave attitude for no reason and were totally incompetent and unhelpful the entire 5 weeks of the ordeal JSA understood that I was claiming JSA and started to give me money

Housing Benefit have now contacted me and saif there was a gap in my claim and I oew £240 in rent arrears

I have called them and been into the office to explain that there was no gap in my claim

their explanaition for this demand for £240 is because I didnt notify them

I have explained to every single person I can talk to that there was a 5 week period of total confusion and I didnt have documents to send them

every time I asked JSA to tell Housing benefit that I was on JSA they refused - they kept saying I was still on sickness benefit - it all just went round and round and no-one could have cared less

I am confident that Housing benefit are fully aware of what they are doing

they know there was no gap in my claim and this ploy to pin the blame on me for not sending forms is a total smoke screen

Anyone can see that there was no gap in my claim and I have documents to prove it

to say I owe them £240 for JSA incompetence is deliberate manipulation of the facts

They have deliberately sent me from pillar to post and they know none of my running around is going to change their decision

I feel I'm totally at the mercy of people who are deliberately planning to get me out of the flat by falsely causing arrears that they know I cant pay

could citizen's advice help me? what are the legal rights of someone continually claiming benefit? Surely I am entitled to get that benefit?

I need someone to fight my corner - they know they have got me where they want me

    Citizens advice should be able to help, talk it over with them anyway.

    But, I would call JSA & ESA (or Incapacity Benefit, don't know which one you were claiming) and ask for a 'proof of benefit letter' from each of them. Ask them to detail the dates you claimed both benefits and take it your housing office as evidence.

    Obviously, I can't speak for the housing office advising that they are charging you £240 for not keeping them informed. (ask for the proof of benefit letters, but keep your housing office informed of what you are doing.)

    Hi Grai

    First of all calm down - they are not going to evict you. The same thing happened to me and I had to write an official complaint to Job Centre Plus in order to get a letter sent to the Council. JCP have a complaint form so get one next time your signing on and fill it in and send.
    The reason you are getting letters from the council is because you have agreed to pay them rent - the fact that you are paying the rent via HB is nothing to do with them.
    If you don't get JC+ to write to the council then go to your local CAB and they will take it from there.
    By the way I owned far more in rent than you and no action was taken! they're bark is worse than their bite!!!!

    I'm surprised you are so active if suffering from depression.
    As others have said, you aint gonna get evicted, and don't be killing yourself!
    Consider yourself lucky that you are not living in certain parts of Pakistan at the moment :eek:

    Calm down, and keep calm when talking to these people, you will get a lot further if you act like a normal
    calm intelligent person. You will not be evicted so stop worrying about that.

    DUTR a bit insensitive, obviously never suffered with depression and grai, can't offer any advice but good luck and hope things work out for you there are lots of decent people on this site to help, only some are less understanding, hope they are not in the same boat one day

  • do take advice - citizens advice should be able to help - if you have depresson there may even be an organisation in your area who would advocate for you. I am sure this is sortable, so do hang in there - and take care of yourself

    They will backdate your rent and if i were you i would out in a stage 1 complaint about mal administration, see if it escalates up to the ombudsman stage.
