Hello EV, hope I'm not presumptuous on thanking you for your post. I felt as you do when I stumbled upon confused's thread.
We have exchanged pm's, but last few have gone unacknowledged, which is not a criticism...I entirely understand the different ways we all need to find just to keep going sometimes.
It's not my place to do so as it's not my thread, but I'm saying Thankyou again for all of us who have been shocked by this case and care about op.
I will also say I have found his comms with me totally impressive, honest and upright.

    Hello All,
I think i Owe some Appologies to some Special people who know who they are!!

Firstly may i Thank Everyone for their support

The reason ive been offline is that shortly after i had gathered all my information and built up a strong enough case in order to get the Bankruptsy Annulled, i was made redundant meaning all accounts not associated with the ones in dispute would need to be paid after annulment which left me in the situation where i would have had little income and major outgoings.

This in turn would have more than likely landed me back in the position im in already making my efforts wasted.

At the moment im spending quality time with my family whilst looking for reasonable employment, but retaining the protection from bankruptsy.

I have heared very little from the official reciever since i informed them of my redundancy, and to be honest bankruptsy isnt as scary as it first seemed.

If i dont fight the bankruptsy, from what i gather i will be hopefully discharged anyway in july as this will be 12 month from my bankruptsy, howvever as ive not agreed to an IPA on my income and am still unsure whether one can still be set up after this time has elapsed, and if it can then would it still be set up for 3 years?

    so..

Really the only things im affraid of is from another problem im facing.

The other worry is that i gave them the valuation for my property which is just about what i owe on the mortgage hoping that they would transfere the benefitial intrest to my partner but i am still awaiting a reply to this.

ATM I've heared nothing since i was made redundant? regarding my bankruptsy?? (which is confusing)

But insurances and benefits are covering bills ATM which takes a little load off.
You'll see most of my posts are between 00:00am and 03:00 am. this is when i sit down to eat my dinner and drink my cuppa.
Any betwen these times are from the office
I may get an early night tonight, 00:30am

I have just noticed a comment about my fish and cats and realised the person was questioning why we should keep them?
This was written some time ago and was surprised by the insensitivity that can be expressed when talking about family pets. (at the time i must have just poopoo'd the comment)

I dont want any replys to this comment as it is actually a very old post which was in conjunction with my SOA info (which in the end my case was seen as valid and i managed to get a much much lower offer) however i feel i need to respond my point of view for anyone else thinking the same.

These animals i.e. fish and cats have been with me and my family for six years+ so think of them as children if you will. these animals have been nurtured and looked after and hold dear in our hearts.

I also have a 1 year old baby so if the persons comment stood should we also get rid of the baby (yes) ?

From what was said, we may as well theyre only material objects after all, draining funds when sick, or need feeding, which could pay for the bank charges and miss sold PPP. maybe pay towards the billions of £'s worth of bankers bonus's, because they clearly deserve it.

(sorry but dont be sooooooooooooooooo ridiculous)

    Rant Over!!

The first lady I saw at the CAB some 5 years ago told me I couldn't afford my dog and should have him put to sleep. Not give him away or put him in rescue, but have him KILLED!

Needless to say, I am of exactly the same opinion as you Confused. We take on the responsibility of caring for our animals for LIFE, not just until we can't be bothered any more, or until it becomes hard work, or the finances get a little tight, or even (with dogs in particular) they don't behave as we would like, so we pass them on to someone else to deal with.

Imagine if everyone did that with their kids? Or if the OR said "you can't afford to keep the children you already have, put them up for adoption".

    Grrrrr...

On another note, sorry to hear things didn't go quite to plan with getting your BR annuled. But perhaps for the best after all, considering the situation you're in now. Best of luck with everything and roll on July.

Regarding the IPA. The bad news, there's still time for one to be set up and it would run for 3 years from the start date. The good news, you're on benefits now and probably don't have any surplus to put towards an IPA!

  • I have 5 rabbits (did have 7, but 2 died last year). I too had comments from people ( F & F included) saying I should get rid of them.

In the last year I have lost my husband, the life I had built up over all my adult life, my home, access to my kids for half the week - just about everything which had any meaning to me. Losing my pets would have been the final straw. I could no more imagine getting rid of my rabbits than chopping off my arm. For the minimal amount that they 'cost' what they give me in terms of restoring my sanity, is invaluable

They now wait until about 2 years and 3 months, to see what the property is worth at that time, before agreeing to someone buying the BI.

If they set one up, it would last for 3 years. But they can only set one up before you are discharged. If your only income is benefits, then you won't get an IPA.

thanks 'SC' thinkwere at the point where we think it would be better selling any way, its not worth anything more than we owe but we have too many bad memories here now to stay.

hopefully if it does sell later then hopefully house prices will have risen enough to get a deposit for another together from the OH's BI.

im sooo gutted that i couldnt go ahead with the anullment im soooo sure i could have done it successfully, i had all the evidence against them and they are soooooooooo in breach of the SAR and all the rest.

i just hope come july i can get them through fighting for someone else!!

On the up side they'll have to prove they are due the money from my BR, and this will be extreamly hard to prove seen as though the OR was included in the corrispondence (appollogies for spelling).

Did you not put by the money you would have paid in tax and pay it over to Moonbeever? If you have a Nil Tax IPA in place then you should have details of where and how to pay.

    Hello confused -
I've not been here for a while, which is not to say you are absent from my thoughts. It has been more a case of respecting your absence and silence: one cannot and should not 'intrude', even virtually, when there is a sense of p.o. needing a time of quiet or retreat or simply, nothingness.
But it sounds as if you are planning ahead again and planning realistically: that is such a good thing.
Your kind words are noted but I disclaim them, simply because it is YOUR goodness and worth that shine through.
I wish you and your family every success. You are a man of many talents[as I have seen via other em's] and you have all the right templates for success and these are also your great gift to your children.
Just remember to keep things simple and appreciate simple things, by making family time expand with bread for ducks, silly games, unexpected nonsense and laughter. The unplanned walk outdoors, roadside stop and explore, or sun on the face wil never cease to work wonders.
    :-)
    All power to you.
