I'd go with Zandoni's suggestion in post 10 if you don't get any luck with playing nice.

You could also write to the local paper about it (and tell the restaurant owner that you're going to do this beforehand).

Go to the restaurant on a busy evening and speak to the manager, they will be far more helpful if you are there and other customers are in ear shot.

    Sounds good.

Or call and say that the deadline for the 'review' is fast approaching and you would really rather make sure it was based on the evening's excellent meal rather than the post-meal experience!
  • It was extra items that where put on the bill, unfortunately we had been there for a number of hours and just paid and left(lesson learned).

They are basically saying that we are lying as the items definately left the kitchen, but there is 8 people at the table that are witnesses that we never recieved the goods. I would have thought any decent plan would refund as a good will gesture. We never criticised them or shouted at them just asking for refund

I have called consumer direct, and as mentioned above the hardest part is to prove it as we never mentioned before paying.

They basically said write a letter asking them to reconsider there decision, give them 14 days and if they don't reply or still don't refund is to take it up with trading standards.

I will also write to THE JUDGE who works for the Daily Record and Sunday mail, he has help my folks get money back for Sky and other places previously

It's a difficult one, but on balance I would advise swallowing it. It's terribly hard to prove whether or not you had a particular dish. Down to experience and check your bill before paying next time.

OP I personally don't think you have a hope in hell. You were presented with the bill which is then up to you to check before you pay.

How can you go back later? Learn your lesson and move on.

Don't want to sound too harsh but that is the reality of it.

    Name and shame.

    Name and shame.

    Name and shame.

    Am I clear?

I think it's the only way now.

Hopefully this will cost them more in the long run than the amount they gained from over-charging you.

    Good for you.
You probably won't get anywhere, so don't make it your life's work or spend out loads of money in trying to get it back. But no reason not to give it a go and see how you do.

As other posters, i dont mean to be harsh at all but the actual principle to me would be to always check the bill and dispute any mistakes before paying. Effectively they have offered you x in exchange for y........and you have accepted.

The burden is of course proving that you never received the dishes in question. I doubt the establishment would know your exact order from recollection unless you are a regular and get the same thing every time you're in. Thus, as far as they know......you're just trying to pull a fast one.

I wouldnt like it to happen to me, however i'm fully aware that mistakes can happen which is why i always check before paying/check receipts immediately after paying.

Although I fully agree with what you said the problem is some restaurant's load up the bills when there's a lot of people. The drink is flowing and who wants to look like a scrooge in front of your guests.
