    Yes you were ill so it will not be refusal of employment.

    Your adviser is not a decision maker, he may have some rudimentary knowledge of the subject matter but will not be an expert. The level of knowledge required by him, really, is just that RE is naughty and should be referred. The decision maker will then decide if you did, indeed, refuse employment and if they decide you did they will decide if you had good cause.

    Mine shouldn't be referred to a decision maker for being ill should it?

    In my opinion, yes it should. Maybe I'm a purist, though.

    Sorry, I didn't mean to worry you.

    What I meant is that the only way to get a fair and correct decision is for a decision maker to make that decision rather than an adviser.

    There could be a list of circumstances under which a referral wouldn't be made and sickness may be on it, I don't know though
