The photo might be yours if you specifically paid for it. The copyright (and that is what is being discussed in this thread) is the photographers, not you.
I suppose that if someone wrote a book about you, you would think it was yours?0 -

You wouldn't hold the copyright on it. The photographer would unless he sells it / signs it over to you. Again, you might own the photo (i.e., the physical print) but you wouldn't own the copyright or any other rights over unless you specifically get them from the photographer.0 -

- agree with that, I've said many times in these threads, i's an agreement / contract. When you commission make sure :
- make sure [#25] your photographer does not retain permissions to use on his / her website
- also [#25] that the CD is so low-res that anything more than a postcard print will be largely unusable / marked as well
- you agree to the Copyright and Design Act 1988, and that you contract in addition for a ' Digital Package '
- Digital Packages shall be given permission to print the images for their own use
- the digital licence includes compatible Electronic publication [ CD / DVD-ROM ]
- the digital licence includes Internet Publication Rights to send pics to family in wherever
- all the above is in perpetuity
- accept the CD in any format including RAW
- the copyright is copyright only because you sign to agree to be copyright [ed], don't sign, you don't have to, say no
- do not allow someone you paying £2000 a day to to dictate the terms of a contract you are paying for
- do not allow someone you paying £2000 a day to to dictate weather or not you will be given usable digital material
- see #60 there are other less Machiavellian ways of the photographer protecting their work
- photographers practices may be legal & lawful but that does not make them ethical
- see #67 [spud17], get the contract early , read it, if you don't like it, then get another photographer
Now any of you snappers want to take a shot at this, it's my third time of asking and people are wondering why when you are so defensively vocal you will not address this point :

The Copyright Designs and Patent Act 1988 gives the client the right not to have photographs taken for private or domestic purposes issued to the public, exhibited or broadcast without their permission. Therefore, although the photographer owns the copyright in this situation, the client can control how they are used. It obviously makes sense for photographer and client to agree from the outset how the images are to be used to avoid difficulties later on.

Whatever eventually comes out of this thread many thousands more people will now be empowered to avoid unfair business practices by the wedding photography industry who hide behind legislation intended for a different purpose.
And each day that passes many more thousands will read & learn why you should not accept the terms offered, it's your money, your commission, you politely dictate the terms and get it in writing.
For those who continue to second guess my motivation / never had a problem with a photographer / wedding / contract of any sort / etc. Remenber we are talking wedding photography not celebrity news or Ansel Adams
For those who may wish to avoid the great big clanking trap of copyright I'll knock up a form of words and post them in this thread, nothing the form of words the photographer will be asked to sign will be unreasonable, but you will be :
- left in control of the images of your family do they can't be splattered all over the net
- left in control of your £2000 a day costs, ie, you are in charge, it is your money
- left with images that are not deliberately spoiled and are of use to you then, and in the futureDisclaimer : Everything I write on this forum is my opinion.
