I think it is immoral profiteering. I have a problem with profits in general though. I have a fairly socilist view of the world and think people should not be trying to make gross amounts of money to the detriment of others (for example only paying minimum wage to workers - I am in FULL support of the Lib Dem's plans to raise the tax threshold as well.)
Anyway, if any of you are interested I will let you know how I get on.0 -

Like most supermarkets if you've not used the new pair then they'll likely be happy to refund or give store credit (not that they legally have to, of course).
Trying to ask for a retrospective discount though because they're available cheaper elsewhere is a non-starter; either except them for the price you paid and put it down to experience, or see if the store is kind enough to allow you to change your mind.0 -
I actually had no reason to feel guilty since the headphones did not fit my head and did not say on the outside how big the neckband was. That makes them unfit for purpose.
Just to point out that them not fitting your head does not make them not fit for purpose. Not fit for purpose and not fit for your purpose may sound similar but are completely different. You had no legal right to a refund for the original items.
Also, just to be pick, profiteering is making an excessive profit on goods in short supply. As these items are not in short supply they are not profiteering.

Well thank you for contributing, adam.mt. Whether or not I get any money back is not my main issue, my main issue is the price they are selling them at in the first place. Sure, initially I was angered at buying something over the odds but the real problem here is they are selling it at that price, perhaps to people who don't know and can't check online due to lack of computer access.

I did it out of guilt becuase I opened their packaging on a lower priced product (in one of those rip-open packets) before finding it unfit for purpose.
I doubt the first set of headphones were legally 'unfit for purpose', just because they don't fit you doesn't mean you're entitled to a refund. Just the same as buying clothes of the wrong size.
You should have asked to test them instore or checked whether you could return them if you 'changed your mind'. If they say no then you purchase from elsewhere.
Morals aside, legally a retailer can charge what they like; if the customer accepts it then the deal is done.0 -

Ok, personally if headphones don't physically fit on to your head and the box does not describe the measurements, that to me is not fit for purpose. I may well be wrong in law but again it's a moral thing, they didn't put on the box "will not fit heads with an ear ot ear measurement greater than x" (yes, i'm being big-headed, ha ha very funny)
I know they can legally, but I can legally do many things I would consider morally wrong. Equally many things I might like to do becuase they are morally right might be legally wrong. I could get into trouble if I tried to offer first aid to someone and they died, even if they would have died without my help. Morally i did the right thing, legally I did the wrong thing. The law is NOT based on morals.0
