Im a bit confused by some of your posts. I cant seem to understand where you are at in the procedure.

In our case the mother stopped access so we went to court for accesss to be restarted. Both parties had to file a statement, her for why no access and him for why there should be access. The atatement had all the background facts and was submitted to the court. The court ordered Caffcass to make a report which was done by interviewing both parties and also the child to get the childs wishes. We then went back to court for the decision.

Have you actually applied to the court for access. Have you not been referred to Caffcass yet?

Process for us is

March - Contact Solicitor
April - Wait for her reply never came
May - After several letter to her requesting she contact my solitor we had a letter from hers
May - As she knows money isnt an issue and a court would favour me, she made up I physically assault my son
June - I had to reply to counter it
July - She saw a mediator to see if she wanted mediation
August - I then had to see mediator to see if I wanted mediation
August - Mediation between us very soon

Mediation is a pre-requisite for getting funding (Legal Aid).

6 months Ive not seen him and could well be 18 months at this rate!

Everything is legal mate, but posts on facebook can be used to clear me of allegations made be her, ive seen them, but cant prove it unless I get proof she put them on a public domain!

Hi, I would suggest you find a public place with internet access then you can get all the FB history you need. I would also amend your earlier post saying you want to kill her. I assume it was just said in anger but there is no point sinking to her low levels.

Also my OH was accused of child abuse totally made up by his ex - she went off the rails when he said he didn't want to be with her. The court cleared him of everything and she was actually deemed an unfit mother and the child taken off her. The truth will out.

I now have regular contact with my son again.

I believe this was a direct result of me reporting her to Social Services on solid provable grounds, she did contact me after 6 months of no contact and said if I didn't say anything more to SS or go to court she would give me what I wanted which was agreed at mediation of 3 weeks a month.

Then I found that my son was in an inch of his life, as she left my son unsupervised in the deep end of a swimming pool, and he had to be saved, and the whole swimming pool evacuated with alarms going off.

I am in the process of getting that report from the swimming baths!

Then he wasn't scheduled to be at mine this weekend, but when he came, he said his step dad had told his sister (aged 10) that he wasn't her dad, and his mum and step dad were really arguing thus him being allowed to see me.

Finally after 6 months hes loving being back!
