That was she pressed pedal and it simply wasn't spongy to touch. And because it didn't act as a break it sent mind in a rather deep cofusion where you stop understanding where your pedals are, as to hit gas in the situation you need break is even more dangerous than not to hit anything!

So as said already, if you had driven the car and found the brakes to not be working properly, you should have taken it to the garage and not let your wife drive it.
Where we are now is you should DEFINITELY take it into the garage where you bought it and tell them the brakes are not working correctly and it is dangerous having already caused an accident!

The garage will fix the problem, and you may have a case to ask them to cover your insurance payout assuming they actually find an issue and fix it. I very much doubt it though since you continued driving it after finding the fault.

Any suspected problem with brakes should be checked out ASAP. Give up, move on, and get the brakes thoroughly checked before you take the car out again.

    Very accurate!

One of the biggest problems that Toyota found was that people would carry on driving theirs cars regardless.

When the throttle was sticking open it was found that the pedal feel would have been getting gradually stiffer for anything up to 6 months before the failure occurred..... Call me paranoid, but as soon as I notice something not right with the brakes or throttle pedal i'd be having the car thoroughly checked over!!

Unfortunately we take the attitude these days that as long as it has an MOT, it must be safe to drive......
Too many people drive about in "limping" cars until something major gives, rather than get it fixed as soon as a small fault appears.

I suspect that there is nothing whatsoever wrong with the car.;)

The OP just seems to be jumping on the " Toyota " bandwagon.

so your wife crashed her car your car both your car from what i gather, the aygo has no related ecu to the prius so hence no related software and no related ecu faults if that was the case when the prius had recall for throttle faults the aygo would be called aswell.

this case is boiled down to your wife being destracted behind the wheel, realised car was stopping infront panicked and hit the wrong pedal, not to sound or look a total fool told you that car had a fault with its braking system you go on internet and search for the fault and come accross the prius brake fault article, putting two and two together and comeing up with a million decide that your aygo has the same fault as the prius and then come on here for advice about claiming against toyato for the fault. your article is related to 2010 model prius, not 2009 even if it was end of year. even further your aygo may have been MADE IN 2008 and REGISTERED in 2009 making you car a 2008 model!! and have no relation to the 2010 fault.

just accept your wife had an accident get to toyota and ask them to test brakes and software even though the car is an aygo compared to the prius the only relation to each other is the badge.
