Sorry, but have I missed the point here - some fickle user who has broken the law and posts on here trying to be a smarta... , asking for help to get out of paying a fine.
Its down to you - pay up - you are not going to get out of it.0 -
Thanks Robert .... very interesting to learn this .... why would the bailiffs NOT have an arrest warrant?
Mark
A bailiff's powers in respect of a particular job are not derived from being a bailiff, but rather from the type of warrant issued by the court* instructing them.
The court chooses what type of warrant to issue (based on a framework of course, not the whims of whatever clerk or judge rolled up to the front desk and signed stuff at random) and car parking fines just don't tend to 'attract' arrest warrants. Maybe it's connected to whether or not you can go to jail for none payment, so council tax is an arrestable offence but a parking fine isn't.
(* most of the time. Landlords can instruct bailiffs for rent without a court order in some circumstances, which are not relevant here but which I'm including to keep this reply comprehensive)If you don't stand for something, you'll fall for anything0 -
The bottom line is you have brought it all on yourself.
Remember who is to blame for all of this - you. I can understand anyone forgetting something, but you said yourself you ignored letters.
which is why you are in this situation.
!!!!!!, it will not go away, ever, pay it now or pay more later.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Robert is correct.
I point out that Council enforcement at the bailiff stage is done by private bailiffs. There is no CCJ.
They have much fewer teeth in this capacity.
Despite this many bailiff's have been known to claim to be 'from the court' or be a 'court bailiff' when pursuing Council PCN enforcement. Some have lost the licence for this, especially those who were recorded making these averments.0 -

lol standred reply ...i expected that .. what i didn't say in this post was that my company were paying it but they forgot lol i ignored the letter (apart from the first one where i told them i had no intention of paying 249 pound for a 30 pound fine ) and yes perhaps i was niave in thinking after a few letters/visits it would be returned where i would then pay as then the idiots ( i appreciate not all ballifs are !!) wouldn,t get paid .. asked for advise not the bleeding ovious or retrospect hindsight !! thanks for the answers peeps just been upto my family solicitors and got them to corospond with this so called reputable company ....will post update when here back .. pete0 -

Yes, you have missed the point. Completely.
Bailiff threatens arrest. OP asks if that's possible.
Answer is no. This is a council parking ticket and so is decriminalised (assuming this is not a 1984 RTRA job). So your proclamation that someone has illegally parked and broken the law is incorrect.
Also no idea why you would berate someone for coming on for advice anyway. If a impropriety has occurred, you'd be BLOODY STUPID to pay x amount. Anyone with half a brain gets advice when dealing with bailiffs instead of just paying what they say you have to.0 -
