Tesco Iphone Contract Change - what can we do?

Hi everyone,
I finally managed to get round to ordering the 3gs iphone last week from Tesco on the 12month contract for £35 which gives 750 mins, unlimimted texts and internet.
They firstly messed me about and sent the wrong colour phone out to me. Apparantly if I want the colour I wanted that I need to cancel my contract and take a new one out. I dont get why!

Now today I get a letter saying that the unlimited is changing to 500mb.

Has anyone else had this letter?

    500MB coincidentally the same as network partner O2 am I right?

    Does that suggest that Giffgaff follow in the near future then....

    But can they do that? I took the contract out last week on the basis that it was unlimited. If within days (not even a week yet!!) they change the terms etc, then surely I have a right to cancel or something?x

    Have a read through your contract and see what is says in regards to them making changes as you can normally get out of the contract.


    However what seems strange is that they are reducing it to 500MB because all there present contracts come with 1GB. (both iphone 3GS and iPhone 4)

    The fact that you used the words 'ordered' and 'last week', with it only being Monday today, would suggest you are within the time-frame to cancel under the Distance Selling Regulations, so having a right to cancel due to contract changes has no relevance as it would not be needed.

    I ordered it on wed last week and got it friday. I tried to speak to them on sunday as they had c0cked my order up as the iphone was the wrong colour. But the call centre staff didnt know what to do if you get the wrong colour iphone!!! So they were going to cancel the whole contract and re-issue another phone and I would have to return the wrong coloured phone. So all well and good. Then they said that as I had used 60megabites of data on the phone at £4 per megabite, I would have to pay £240 bill for the one day use! Hence, I just kept the wrong phone! Hope I am making sense.

    But now the terms have changed too. I am really regretting this as I just dont know what to do!

    Almost certainly does. Giffgaff can't afford to pay all the extra data charges o2 Wholesale will be requiring them to pay for people that exceed 500mb.

    The contracts have always been sold as unlimited with a fair use policy, and they reserve the right to charge if you exceed that amount. The fair use has now just been defined.

    You may not like it, you may feel it's underhand and lies but the fact is the contract has not changed, all that has happened is that the amount that is considered fair use is changed, and they have started to charge if you exceed it.

    This has been raised withe the ASA many times, and the ASA consider the use of the word "UNLIMITED" to be fine as long as most people do not hit the fair use limit, in effect the reported95-97 % of users never hit the limited so the data is unlimited to them,

    Now that to me sounds wrong, it's limited not unlimited, however the ASA disagree and so the term "UNLIMITED" is acceptable.

    Checkling the website the unlimited internet on GiffGaff finishes soon.

    You lucky giffgaff pioneers can even enjoy free UK mobile Internet up to the 1st of October 2010. After that date, mobile Internet will be charged at 50p a day (if you use less than 2.5MB/day you'll pay less than 50p and if you go over 30MB you'll be charged extra at 20p/MB).

    Depending on your use that could rack up a lot. Against o2's 500MB limit, if you could use exactly 29.99mb a day thats 16 days to hit the 500MB as offered by o2 paying £8.33 to use the same as the o2 deal thats bundled into the o2 line rental.

    Have you yet asked them why it is only 500MB and not 1GB.

    As all the contracts tesco sell on there website with iphone 3GS/4 state 1GB.

    And have done since at least when the iphone 4 came out.

    I think you need to also check the contract.

    As you have gone from unlimited to 500mb. But all the contract sold around the date you purchased yours say 1GB.

    As i purchased my iPhone from tesco on 7th July on a 12 month contract and i got 1GB.

    Hi,

    The contract said unlimited (750 mins, unlimted texts and data) but I got a letter yesterday from Tesco that says :

    "unlimited data until 1st Oct 2010. Fair usage policy and terms apply. 500MB additional data bundle available for £5/month from Oct 2010.......
