first of all i served 9 years in the royal irish, and i am now employed as an MOD civil servant, dont know where you are from but that is what it is called here, so be very careful how you word things, i gave 9 years for my country and i am classified as a civil servant and i have paid my dues so to speak. thanks everyone for all your advise and help, i am glad for those that were honest and understanding and very helpful.

Don't get on your high horse I asked about whether you were in the forces because I know the rules are different than they are for civilians. And I also know that whatever they may call you there, civil servants do not work in the mess or the barracks and have very different terms and conditions. That's just a fact - whatever they may call people, the terms and conditions are all that matters. If you are looking at how things are worded, I am looking at this purely from a legal standpoint, because I do know all the regulations around both service and non-service contracts, and your posts have been neither informative nor well worded. But be blowed with it - you don't want advice and don't want to clarify exactly what you do and what is going on, be my guest.

I said no such thing. I made no comment or judgement about either. I said, and I am correct, that there are three categories of staff - forces, civil servants and civilian staff and they ahve different terms and conditions, determined in different ways. I know this for a fact. I was trying to help you. Your posts have made little sense throughout, and I was trying to find out what was the facts so that I could help you. But I do not owe you anything and have no inclination to give you any advice.

SarEl is a highly experienced employment barrister. Her advice could be invaluable to you, and would no doubt cost an absolute fortune in the 'real' world.

You'd do well to calm down and answer her questions as she's offering you valuable help for free.

everything was fine and getting advise was just great so you really didnt have to inter in, also just for you info, since you know everything, i did work in the mess and i did work in the barricks and i did work in the MT as a "civil servant" and maybe its hard for me to post clearly because i dont understand everything so i can i know how to word it, so i would be greatful that you back off cause you dont know everything obviously if you dont think civies work in the mess or barricks. others have offered help with my not so clear posts so thanks but no thanks from you.

    Wow time of the month?

He said nothing of the sort; he is trying to establish whether you are

    1) Armed forces member
    2) Civil Servant
    3) Civillan staff

    Which is it?

It can be hard to see a difference between them but the contracts and legal position is different.

One thing I have discovered is that you can't help some people. But "he" is a "she" :) If the OP is gone then he is gone. If he isn't, then the answers to the questions I asked are pertinant to the help he may be able to get. But perhaps this attitude explains why he is three months gone and out of time for his appeal?
