Actually it's above and beyond your staturory rights.
SOGA says that you have the right to return it for repair, replacment, or refund if an item is faulty. However it depends when you get the item and discover the fault.
The time frame for a refund is not defined other than "reasonable" a few weeks is usually considered about right. This is not the case here.
So the phone could be repaired or replaced, but under the SOGA it's down to the seller to make the choice not the buyer. they may offer a refund but thats over and above the SOGA in this case. They could repair the phone, and it goes wrong again, and repair, it and it breaks and so on until the warranty runs out, and be withing the act. Offering a exchange after x returns is above the SOGA.
To be honest I though CPW had stopped the "no lemons" guarantee they used to have where they replaced after x times.
Something else top bear in mind is anything going wrong in the first 6 months is considered to be a manufacturing defect, and the retailer would need to prove otherwise if they wish to reject the claim.
After 6 months the onus is on the buyer to prove it was wrong at time of sale rather than going wrong. Mainly you'd have to prove any defect is not wear and tear on the item.
You could request that the repair is in a reasonable timeframe, or request compensation, but if they lent you a loan handset then it would be hard to do this as they have given you an alternative to use.
To the OP: Pretty much any repair of a phone will involve re-flashing the firmware as a starting point, I'm suprised they didn't tell you to back it all up before you sent it off.
I had an Experia X1, after 6 months sony pretty much dropped it, and no-one held any stocks, so they may not have even had any thing suitable to swap it with.0 -

ok check with them how long it should take really. im guessin you've tried a soft reset? did you save images onto phone or mem card?0

I took it to another CPW today that were a lot more helpful. They tried another battery and charger and there was still a problem so I've sent it off for repair. They think it could be a problem with the usb port. They've advised me that it may take up to 4 weeks but current turnaround time is around 2 weeks. Fingers crossed.0

I too have had a problem with the charging of my X10. This was through Orange though and they arranged a replacement Case to be sent out to be immediately. They swapped it for my old one and this fixed the problem. I think there may be a problem with the X10's, but atleast the service from Orange was quick and painless.0
