    I have been looking through the HIPS report and I cannot see/find any land registry number or any mention of it?

    If there is a HIP there has to be evidence of title in there. Either Office copies if registered or an epitome of title if unregistered.

    There is just so much information, im finding it hard to work through whilst watching F1 practice! :rotfl:

    Hi sorry just read the 3rs post above- if the deeds are in the HIP from the 60s then itll be unregistered.

    Not sure what the hold up is if the 1960 deed is a good root of title - have you got a solicitor?
  • Our solicitor has been provided by the bank (halifax).

    We are going to have to purchase the land registry title then arent we? Ive no idea how much this will cost though?

    You buy the property and then you register it with the Land Registry.
    You will get the current fees from the LR site - here's a link.

    http://www.landregistry.gov.uk/

    Tick first registration and enter price etc to find out their fee.

    Normally registration is absolutely straight-forward but obviously your solicitor will charge.

    Terry W is right- The solicitor will prepare the application for first registration on completion.

    Its the normal registration fee not the voluntary first registration fee however- the voluntary fee applies if you're the owner of already registered land.

    This wont be what's holding things up.

    Assuming that all of our assumptions are on the right track, I would guess that dealing with unregistered land is relatively rare these days. Cases of an unregistered property from the 60s being sold nowadays will be unusual, and the majority of the rest of unregistered land probably belongs to the crown or limited companies etc.

    A possible answer to the OP's problem, and I say this half in jest, is that solicitor has not come across this before and is mugging up on the subject!

    Well ive checked the "first registration" price and it is a measley £60!
    I cannot believe that something so simple can be holding up the sale?
    Does anybody believe that the vendor may be holding out for somebody to come in and offer more (even though the house has been taken off the market) or am I being slightly paranoid?

    I just want this to all go through smoothly and we are excited about buying this house as it has massive potential and therefore could be quite profitable when we come to sell in 10 years or so (dependant on the market at the time of course).

    Surely unregistered title, when all the original deeds are available and straightforward, shouldn't be holding up the sale as it happens all the time.

    The bigger delay when you're buying a house in these circumstance is more often probate. When did the previous owners die and has probate been granted?

    the complications aren't the cost of registering, but the difficulties and effort in tracing title so that it can be registered
