Three - Change to terms of contract, can I leave????

I purchased a contract from three (3) mobile in May 2010 on a 24 month basis. I got 300 minutes, unlimited 3to3 calls and unlimited data. It stated this on my May & June bill.

However in July my bill indicates a limit of 500mb data download rather than showing unlimited.

I feel I have been fobbed off as 3 keep referring to their "fair use policy" which they are unable to supply me a copy of. They state that they are just showing the limit of their fair use policy now.

Surely they can't just change my contract without any prior notification, a couple of months into a 2 year contract. The chances are I won't use that amount of data, but to me that isn't the point.

Does anyone have any advice for me????

    I was wondering this also, i know they have introduced a limit but can you leave?

    Although i don't sem to go over my limit, how would i know unless I got a big bill?

    Its the fact that my bill specifically stated "unlimited" data...subject to fair use policy. This month is is specically capped at 500mb, surely they can't make that change without prior notification?

    The 'unlimited' was always capped at a 500mb fair use policy. It would have been in the small print. Now they have dropped the 'unlimited' word itself because there was so much confusion - so actually the terms haven't changed. You got 500mb before, they just called it unlimited.
    I'm not saying this is right by the way, just how it is.

    Thanks for the info, I'm trying to obtain their "fair use" in writing, but they don't have anything.....that doesn't seem right?
  • Put a £0 limit on it.

    Just phone them up and ask for this. I did, so I know I will never go over my monthly payment that I signed up for.

  • You signed up to unlimited with a fair use policy. All Three have done is clarified what they used to mean by "unlimited". It wouldn't make commercial sense to have infinitely unlimited internet access as there are people who would simply stay connected all day every day and hog bandwidth preventing others from using the service.

    The ASA have ruled that phone companies can call things unlimited and place a cap on their use after which the customer has to pay.

    Their reasoning being that if few people exceed the cap then it can reasonably be called unlimited. It apparently hasnt occurred to them that possibly few people exceed the cap due to it being there in the first place and are therefore just keeping below an arbitraty limit that in no way corresponds with their initial promise of an unlimited service.

    Then again the ASA have a near perfect record of distorting reality to allow comms companies to mislead the general public so this is nothing new.
