    Anyone moaning that they've got no snow can have ours! :mad: I hate it and I also hate the d*ckhead drivers who think it's fun to race around and skid all over the place especially when they're already up my ar5e!!!! :mad::mad: I've nearly been hit a couple of times today!!!

    Don't know if I told you all about one of my neighbours in the summer complaining about my conifer trees??? Well actually he complains about anything and everything!! :cool: I got a letter off his insurance company today telling me I had to remove them!!! :mad:
    Apparently they've caused subsidence in his garage!! He got an arborist to exam the area (they took samples of the soil) - not his garage floor tho that was supposedly cracked but they haven't shown me any proof!!! The thing is its a clay based area around here and quite a few houses have had to be underpinned due to subsidence!! Neighbours insurance company are saying it's just my conifers that are causing his problem - not his cherry tree a couple of foot away from his garage or his other neighbours tree/shrubs which are up against his garage!!:( and amazingly up until recently he had an apple tree in his garden about 2 foot away from his garage and its disappeared!!!!! Which I would say is what has caused his subsidence!!!!!!

  • Managed a whole £255 today - have transfered all my Direct Debit money into a savings account until they are due so I can't spend it by accident. Just have to remember to transfer it back at the right time! :D

    Surely they can't make you do that?!!

    Well according to his insurance company they can take me to court if I refuse!!!:( I can't afford solicitors and my local council aren't interested!! They told me to seek legal advice!!!!
    Now I've already cut them right down to less than half their original height but nope thats not good enough for them!!! We'll see what happens next after the gobful the pompous twit representing my neighbour got today on the phone!! :o
    I think whats got my back up more than anything else is the way he's gone about it! He coudl've come to me first! And I'm sure he's upto some scam or other!! He has 2 extensions on his property and I found out today from council planning dept that he has never been granted planning permission but as it's over so many years and no one has objected it doesnt matter now!!!!!!!!!

    OK then Green. I will quote you something from my own experience. Part of it you may not wish to hear but the way it happenbed was as follows.
    Some years ago, I was living with the witch from hell in her house.
    Her neighbour had some fir tree like things that were quite tall and in close proximity to the house's outer wall. There had been instances of subsidence but her (my witch's) insurance company had only patched up and the monitoring was ongoing as they didn't wish to pay for underpinning. In this instance there was no doubt abvout what had caused the subsidence. Trees of that type are notorious for damaging foundations due to the way roots spread.
    Anyway, my Witch's insurance company insisted that the neighbour didn't let the trees exceed a certain height. The reason being that the higher the trees grow, the more the roots have to spread in order to find enough water to feed the branches. Lopping the branches and reducing the height periodically prevent such root spread. So from that, I deduce that your neighbour's insurer can insist on you taking action to prevent further damage. However, the points remain concerning which tree(s) caused the damage, who they belong(ed) to, whether the damage was actually caused by trees, proving it, and whether they are entitled to insist you remove the trees if lopping would be sufficient to prevent further damage. Indeed, sometimes total removal can cause as many problems as it solves. However, if they are the type of trees I think they are, they are known for causing such damage. In addition, if yours or your neighbour's houses have the old clay tiles, the leaves from such trees can rot them over times.
    Just a quick disclaimer. I'm writing this as a layman who knows a bit about this subject from personal experience. Do not rely on anything I have written please.
    Another angle. Maybe it might be worthwhile getting your own house insurer involved at an early stage. If it transpires that you must be rid of your trees, you would perhaps be preventing a future claim against your insurer? Maybe that could be taken into account when apportioning who pays for what? (and pigs might crap on the moon - yeah right!! ). In any case, there is a good chance that your insurer provides legal advice as part of your cover. Even if they don't, maybe you belong to something else that could provide such advice free of charge. A trade union maybe?

    I'm not in any trade union or anything.
    Plus my house insurance is due for renewal next week!!!!! bl00dy great timing!!!

    First off we've inspected the back wall of his garage which is on the left hand side towards the bottom of my property (we think its actually over on my property but too long ago now to do anything about!) There is no sign of any cracks or bricks dislodged/loose whatsoever! strangely when he first mentioned it he said it was his garage floor that had cracked never mentioned the wall!??! now he's saying its the wall!!!

    His insurance company appointed the arborist who has stated that the cracking to the garage has been caused by subsidence, as a result of root induced clay shrinkage, exacerbated by the nearby vegetation and he has recommended the removal of my conifers - which he calls a cypress hedge! er its not a bloody hedge its a group of conifers and theyr'e not the leylandii ones that i think were banned some years ago?! I did ring a tree surgeon and 2 garden centres who both said that it could cause more damage to remove them completely rather than cutting them right back - which is what i have done. Also that the roots of the conifer are very soft.

    My neighbour also forgot to mention to his insurance co that he had already had subsidence on his garage about 10 -12 years ago which he blamed on my soil!!!!??? as I didn't have any conifers near there at that time!! He asked if his workmen could come over on my side and repair the damage - i said yes and I also remember the mess they left, throwing my soil all over the place away from his garage!
    He is also the one who asked if he could cut the conifer branches that had grown over his side - I said yes go ahead - he went ahead alright (standing on my shed roof without permission) and threw all the branches that he cut (and he cut a lot!) down behind my shed which is also directly in front of his garage! thats where I found the branches this summer all rotted against my shed wall and his garage wall!!! Now my shed wall doesn't look too healthy thanks to him doing that.

    Also I wanted to know why he hadn't mentioned his apple tree that used to be right near his garage cos his wife used to give my kids a bag of their apples!
