    OP wouldn't get a fine.

    If his car failed an MOT, his current MOT would still be valid 100% and would still be shown on VOSA's database and on Police ANPR systems.
    So, the OP would have nothing to worry about.

    Yes, i have also been told by my MOT garage that an early MOT & failure would cancel out an existing MOT.

    He said this would only show to a police officer if they actually delved deeper, i.e. the ANPR wouldn't flag you up as having no MOT as it would show the original expiry.

    Truth is, the MOT testers probably don't know themselves, half the time. If you Google you will find the same argument is repeated all over the web and no one can ever provide a clear rule about it.

    If your car is unroadworthy, MOT or not - you are committing an offence. There's a BBC site here that says
    [FONT=Trebuchet MS, arial, helvetica, sans-serif]However, if you intend to drive your car away from the test station with a Refusal of an MOT Test Certificate, there are some stipulations. It is illegal to drive a car of MOT-testable age that does not have a current MOT test certificate on public roads, with the exception of driving it away to a place of repair, which may include your home residence. From there you may be permitted to drive to a pre-booked place of repair, and to a pre-booked MOT test station.[/FONT]
    This reads to me like the old certificate is still "current".

    But like i said, it's an offence to drive an unroadworthy car so both parties are right. A police officer could find the recent MOT fail on the computer for your car and do you for driving an unroadworthy car - if you'd fixed the problem then there's no offence been made. (from what i can gather)
    But yeah i agree it's silly and the new MOT should cancel the old one out in the event of a failure.

    However, I have to say the my irony detector is going off big time, reading sassy one repeatedly tell someone else that they're wrong.

    If you fail an MOT 6 months before your old one expires, does that invalidate your insurance? :rotfl:
