Looks like I might have to go bankrupt after all

  • Even though he still sees them for a couple of days he should still be contributing financially. If you go to the Child Support Agency, which is still running at the moment, with 4 kids he will have to hand over 25% of his net income minus an allowance for the number of nights they stay with him during the year. 52 - 103 nights will give him an allowance of 1/7, 104 - 155 will be 2/7 etc. Also contact either CCCS, Payplan or CAB immediately to try & relieve some of this stress if you're not coping at the moment. Once you have a positive plan of action you should start to feel a bit better even though the first few months of a DMP will still mean a few phone calls here & there form creditors, but these eventually usually stop.

He pays me £50 a month through the CSA-even if he paid more I wouldn't get any more money because of being on income support. He's a taxi driver-self employed-so can get away with claiming to earn less than he does.

    Hey hun

Sorry to see you are feeling down :grouphug:

The best thing would be to give CCCS, Payplan, or National Debtline a call. You are not in arrears at the moment and you haven't any defaults. That means you haven't been harrassed by calls, letters etc. Get one of the advice agencies on board before it gets to that. With young kids and your other emotional problems, you need this help to sort it out. You are doing your best, now it's time for some help.

    It will get better xx

  • Did the online thing with CCCS and they recommended bankruptcy on the figures that I gave them.

Get in contact with Abbey/MNBA (by letter is best) and tell them that. Give them a reasonably short period to reply.

There will have something about "helping their customers manage their problems" on their website - quote it to them.

Please go and get some face to face advice, look up your local CAB, Money Advice Centre or Law Centre and get some proper advice. On Income Support it will be hard to pay that level of debt off so maybe bankruptcy is the right option. It really isn't that scary so please get some face to face advice before you worry yourself even further.

They have refused-I have told them that if they can't reduce their payments/interest I will have no choice but to go bankrupt but they're not interested. They will review it in 3 month's time once I have proved to them I'm not going to spend any more on the card.

I saw someone who advised me to offer reduced payments and wrote to all the creditors for me and only lloyds have agreed to freeze interest-none of the others have agreed to anything (Barclaycard agreed when i rang them up to halve my payments and freeze the interest).I'm worried they will take my car(vw sharan-need 6 seats for when OH comes to visit),I'm worried they will look at my bank accounts and decide I have too much on rubbish(like takeaways or something)-I haven't bought anything big or gone on holiday-I'm worried my landlord will kick me out-and with the kids and pets I don't know where we'd find somewhere as good :(

4 kids and he contributes £50 per month ! (£12.50 a child per month)

Something wrong with the system there.

Basically the tax payer (Joe Public who might be working on long hours and not be able to afford kids of their own) is paying to bring up his kids and not him.

Sorry to not be much help on your thread (but as a bloke, dads who don't take their financial / emotional responsibilities to their kids seriousy annoys me, particuarly if my taxes are paying for their irresponsibility)

    I wish you well.

I know..it's unfair I agree-he should be paying me a lot more so I would be able to come off income support :( I can't stop claiming Income Support though as I can't make ends meet as it is-I'd struggle even more without that maintenance and Income Support payment :(
