Heelixx - look up at the green bar - go "User CP", then under "Settings and Options" to the left of the screen hit Edit "Ignore List" and add any specific poster who bugs you to your list. Makes life more peaceful
mchale - you say elsewhere you are a LL yourself. That shouldn't mean that you instantly have to disbelieve what is said by a poster who is a T. Other LLs on this site manage to keep a balanced view.0 -

Update:~
*HLAC = The case cannot progress forward as they don't think it will be a good case to proceed with from a financial point of view! In the words of the advisor "Sometimes, it's just best to cut your losses" !
Police = Dropped charges against LL due to lack of evidence + flatmate is not going to give evidence (his apparent reason is "I had a few to drink")!
Local Council = Have no clue about anything full stop even when presented with documentation.
Inland Revenue & Customs = Investigating LL on taxable income & illegal workers. (one positive step)
CLA = Responded with a list of possible Solicitors to contact.
So looks as if i will have to cut my losses & move on from the gutter, I simply do not know what to say anymore.0 -

I was only thinking about you erlier when I was out.
I am staggered to see what you have written. I actually am rubbing my eyes like a cartoon. They dont think its worth proceeding from a financial POV! What a pi55take
I think your best bet right now is to contact one of those solicitors.
http://www.crampcoeastbourne.co.uk/criminallaweastbourne.html these seem to specialise in landlord and tenant but personally Id prefer a firm recommended by crisis or shelter.
Have you seen the thread "rogue landlords" there are some interesting cases there, along with the settlement amounts. I think if you havent seen it it would be useful to have a good read. Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

This Ive come to know...

i think its fine telling poor OP all about his rights.. but the reality of it is that even if he takes LL to court, LL will not pay up... courts are full of cases which are won "in principle" - but getting the money out of the defendant can be impossible... we all know that...
so instead of raising OPs expectations in telling him he may get compo via suing the LL - why not lets help him find a new place to live and quickly.......
sometimes.... wrong as it is and unfair as it is.... we must accept that we cannot win a particular battle..
what goes round comes around... and this LL will get his comeuppance in due course....
Let OP get on with his life and regain some contentment
LLs like this make me sooo angry, they besmirth the good reputation of most of us.. and i send my most sincere sympathies to OP....0 -
Heelixx - sorry to read that you're not getting much support. Do make an appointment to see one of the solicitors on that list from CLA.
Clutton - I agree with you that getting a court judgement can be difficult. This LL however is also a pub LL, and the license is held in his name. Aside from the fact that that means he has a salary against which to push for an attachment order, if necessary , for him to be able to renew his license he has to be able to show himself to be of good character
There is also still time to run on the Fixed Term joint tenancy and the OPs belongings remain at the property and so the OP would undoubtedly benefit from seeing his own *qualified* legal adviser.
The police should have been aware that they were dealing with what seems to amount to tenant harassment and unlawful eviction. As Lynz says, that too ought to be followed up.
The OP can pursue a civil action for the LLs' breach of the T's right to quiet enjoyment0 -

Heelix,
I know parts of this debate have been reproduced elsewhere on this site, if you havent read it in full it is worth taking a look at.
You could always make representation to your MP of another case ( ie you) that has had poor response from community staff. Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

heelix, read this thread, towards the end, a case of an illegally evicted person who sued the police.
Worth a read. Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Something new for you today guys,
This is how bitter & twisted the old man (LL) really is. He has now got the Unemployment service to send me a letter regarding the "UNPAID WORK" in the bar downstairs. It would seem he really can't let sleeping dogs lay & would like to make my life as miserable as possible! It states in the letter from the Jobcentre & I quote:~
"The employer (sorry I do not have a record of who they are) states that it is part of the tenancy agreement that you do this work, please can you send me a copy of this agreement?"
In the actual tenancy it does not stipulate names of who will work in the bar & who doesn't. So as it's a joint tenancy Mr. B!! can go work in there.
This is just to show you how sad & a desperate man this LL really is.
More info coming soon.0 -
What is the exact wording of the TA?
Where are you living now? Are you still with freinds? Did you get a solicitor engaged? Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
