    I don't believe that any disciplinary action could hold up. They are using, at the company's behest, a private email address for work. What the user does with that email address is not and never can be under the control of the company. The user has inadvertantly used that PRIVATE email address on a dodgy site somewhere and now gets spam to it. That's life.

    They accidentally clicked on a link in the email but terminated the connection as soon as they realised.

    The company have no comeback on the user at all. Their IT policy is a total shambles. How can a company operate using employees personal email addresses?

    I don''t disagree with the shambles - but to be accurate, as I said, a dismissal probably wouldn't hold up. A disciplinary is another matter as there is no external right of appeal. If the company is now getting its house in order it may hand out a few disciplinaries to prove the point about what will happen to people in the future. I'm not suggesting its fair - but disciplinaries don't have to be! It wouldn't be the first time that someone has been disciplined without good grounds to prove a point - and it wouldn't be the last either.

    Any medium to large organization will most likely have the ability to (a) see how long per day you were on the internet (b) the time periods spent per day (c) all the sites you visited (d) the time you were doing all this (e) the amount of data transferred. All this is done through monitoring software outside your laptop - just a press of a button away.

    Also exchange 2003 (outlook email backend) has an easy facility to trap every message without the sender or receivers knowledge and is totally transparent.

    Non of this has to do with wi-fi. Once you type in your user name and password your are on the company domain, the IT department 'know' it is you. These credentials will also be used for the web tracking too.

    This all sounds very suspect for one Russian babe email. I am of the opinion you are missing out something big, or they are really out to make an example of you by scaring the others, and reduce staff in recession period.

    we dont have logins and passwords for each member of staff.... its the same details for every computer in the dept... same password and username for every computer:(

    but they asked for an email address when you join and that where all emails have gone ever since.... WE HAVE NEVER BEEN SUPPLYED with a company email address. untill monday just gone... but that does not go live untill next month. so we have a company email address now but cant use it till next month. but we have never had a company email address till monday just gone and this matter happend over 5 weeks ago

    Then there is very little they can prove. Personally, I would withdraw the use of my personal email from the company immediately. Your good will in providing the email address is being abused.

    As for the common logon, they have no business accusing anyone of anything.

    The IT policies of this company are an absolute joke.

    Why don't they just punish the person who downloaded the movies? What's the point of "making an example?"

    Hang on OP you say you were day off when the downloading of films etc took place so why would they blame you for that

    The OP isn't being blamed for that. They used the movie downloading incident as an excuse to audit the other laptops, when they found the offending website.
