Your replies are now starting to make me think your guilty and playing a numbers game as to whether they can prove your story wrong or not.
1) You are correct but there are other factors that could help them do this.
2) I think you would be surprised on this. It can be easier to back up everything than targetted back up.
Judas - this wasn't posted by the OP! But I would otherwise agree with you - most people have no idea how much of what they do on a works computer is recorded and how much of their "history" is available to the company. This is definitely not unusual these days. IA company that has no backups, no server, no monitoring, etc - now that is unusual.0 -
How is the downloading of 15GB of movies related to the email? You said in your first post the colleague used "his own laptop" through the work's WiFi? But then you said "it was unlucky for me he used mine when on my day off." Did he use your laptop or his?
Yes he used his laptop on the wifi that is asigned to my computer....
hense the reason my laptop was taken... the bb usage for my work station if you will was huge. so they removed my laptop and this is where they found the web history.
It was my day off on the day he did this other wise there is no way I would have let him go ahead with this0 -

You aren't answering any of the relevant questions. Nothing you have said indicates that they have believed for one minute that you downloaded the films - so none of that has anything at all to do with your lap top and what you may or may not have done. Forget why they took the laptop - it's theirs, so they can.
Now tell us what they found, what you did (really what you did - if you don't tell us the truth them any advice you get is useless), and what they are saying they will do about it.0 -

could not tell you if it was company policy to have work emails sent to your home email address... but they asked for an email address when you join and that where all emails have gone ever since.... WE HAVE NEVER BEEN SUPPLYED with a company email address. untill monday just gone... but that does not go live untill next month. so we have a company email address now but cant use it till next month. but we have never had a company email address till monday just gone and this matter happend over 5 weeks ago
the reason I have pointed out about the film downloading because it breached BTs fair usage and now the company have to pay some higher price for there Broadband. So the company is upset to say the least and wants to make an example out of some one.
yes the page I opened was NON !!!!!!... But company policy states that no other websites can be viewed except those that the company allows.
now I have been to my investigation... And the questions asked are what I have already stated.... do I know anything about the fim downloading, have I viewed any other site than the ones the company agrees to, can I tell them about russian brides.
they are looking for somes head for this as it has cost them a lot of money..... I only hope its not mine0 -
If you are only allowed to look at company websites, maybe the company should block everything else. Problem solved!0

A wi-fi connection is not a single point connection. They can not say that it is your connection.
If they have/had logging on the router it would log the MAC address for the computer connected to Wi-fi with the IP address allocated. The logs would also show the IP address that downloaded the films (or at least the site that they came from). MAC addresses are (or should be) unique so this would tie the downloads unequivocally to your colleague's personal laptop.
If the company run a proxy server then they can tie every web address to the specific laptop. However it sounds as though the company doesn't have a clue especially if it expects you to use a personal email address for work business.This is a system account and does not represent a real person. Ask for the companies list of websites that are allowed.
Bet everyones web based access to email will not be on the list.

Based on what you say here, it would appear that their IT policies have been less than exemplary, and provided that they know that it wasn't you who downloaded the films (I believe you said you weren't in work that day which would be pretty conclusive), and all they have is one single "questionable" history, I would not think a dismissal would hold up to any scrutiny. Which isn't to say that you might not get a warning, because whilst you can appeal that to the employer, you can't appeal it to a tribunal. But a dismissal would probably be unfair and a reasonably good case - provided everything you have said is correct.0
