    There is no appeal procedure for contesting a decision, there is only an appeal procedure if the candidate can prove that the test was not conducted in accordance with legislation.

    A successful appeal ( highly unlikely ) on the grounds above will result in another test being granted without charge.

    My information came from a retired driving instructor, this guy was THE man to see if you wanted to get on the road with minimal fuss.....

    They can't just pass everyone who comes for test, questions would be asked as to the standard of the examiners. This is tick box Britain we're talking about.
    "why is XYZ passing more people than the national average???? hmmm mustn't be doing his/her job right"

    Despite all the claims to the contrary, examiners are monitored to ensure they're meeting the national average pass rates.

    Here's an example of an examiner talking about pass quota's
    (Although not fail quota's it does show that there are quota's none the less)

    I concede that this was back in the mid/late 90's, is it true now? I don't have a clue, but why would it change?

    Oh, by the way I passed both my theory and practical test first time, I also taught an ex to drive (apart from 3 lessons) and she passed first time too :cool:

    The fact that examiners pass rates are monitored does not necessarily mean they are required to pass and fail set numbers.

    Generally, their pass/fail rates will fall within a range which is consistent between examiners. Those falling outside those ranges MAY be more strict or lenient than they should be and will warrant further investigation which may show this to be the case or not.

    This is not quotas. though, it is normal quality assurance.

    Many government agencies and businesses take this approach - they identify what is abnormal and look at that in more detail because the QA risk associated with it is higher.

    OP will do better to think about how she might do things differently next time than to worry about the "justice" of the situation.

    "too close to the kerb" is also a term that is dependent on speed. Brushing against shrubs on the left hand side other than very slowly is likely to disconcert the front seat passenger and if he is your examiner then that is not really conducive to passing.

    Nothing you've said in this post convinces me of your argument. It's nothing but hearsay and 'I know a man in the business who told me..." claims that I could just as easily counter by saying I know another retired driving instructor who told me the exact opposite.

    There is a profound difference between figures being monitored and examiners going out each day knowing that they must fail a given number of students and pass another number of them.

    Of course if a student turns up, drives a perfect test and answers any questions correctly they will pass their driving test. To believe otherwise is edging into conspiracy theory territory which again, exists only to ease the pain of people who fail their driving tests.

    Also, I'd have bet everything I own on the fact that you'd follow up your last post by saying you'd passed first time. :rotfl:

    He would of got done for obstructing the road, either way that examiner were going to find a excuse to fail the candidate.

    If you really think you were hard done by then read the notes on the back of the paper and proceed. If you're successful then you will get a free test, as someone else suggest, you might want your instructor in the back next time - although this may or may not add more pressure for you.

    You can appeal if you wish but as said above it is their word against yours. If successful they will allow you a free retest. I have heard of people who have done this and then had problems because they have got the same examiner on the retest and "obviously" got failed again (a bit too much of an olds wife tale for me to believe personally!)

    You have to ask the examiner to allow your instructor to sit in the back, they should allow it.

    They have in theory, changed from having quotas but I do know someone who did the admin at a centre in the early 90's and says they definitely did have them there and then and failed people they otherwise wouldn't because of it.
