Can I sue my Solicitor...PLEASE HELP! :(

    Im at a point now where I see my only escape out of this to leave the coutry (which I can afford to do) or kill myself.

    Assume you mean can't afford to.

    Third option is to declare yourself bankrupt (post on the Bankruptcy board).

    Not sure your bank will be prepared to wait for the money while you sue the solicitor. If you hope to recover the £90k from them it'll be a long process.

    Did you buy the house without telling any of your friends and family or asking for any advice?

    you cannot sue a solicitor in the small claims court so you will incur further legal cost to sue him.. and if you lose you - will then be reponsible for his costs as well as your own.

    Richard Webster will no doubt correct me if I am wrong, but I don't think you can sue the solicitor for the whole of the £90K shortfall as this has been caused by your failing to honour your agreement with the mortgage company.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I agree with Lincroft1710, surely your solicitor must have provided your mortgage company with all the documents required or else they wouldn't have released the funds?

    The angle I would be looking at is how the funds got released as a mortgage if it hadn't been built? I thought you needed a kitchen sink for a property to be mortgageable, surely at the stage you completed it would've been classed as a self-build? If the solicitor acted for both you and builder maybe something dodgy went on there?

    Also why when you saw all you mortgage going up the builder's nose did you not say something to him? Why have you not sued him? Even now you are talking about suing the solicitor and letting the builder get away with it.

    At the end of the day the house is being repossessed because you completed on an empty shell and then didn't keep up with mortgage repayments.
