Right the whole story is a long one! so i will try and keep it to a shortened version!
Basically...in 2005! a so called friend/property developer was building some houses...at the time i was a dancer earing a very lucrative wage...so instead of wasting my money, after some persuasion by my friend, I decided to buy on of his properies.
The house was unfinished when the funds were realeased...he then went and spent the proceeds on a ferrari and a load of cocaine and could no longer afford to finsh of my house!!!!
So...I spent altogether about £10k on mortgage payments, council tax and legal fees surrounding the original sale. Now I was left with a shell of a house...no elec, water or gas...just walls and windows!
I was only 20 yrs old at the time, couldn't tell my parents and had no dominant male figure in my life nor anyone to turn to for advice...and I had spent so much money trying to pay my mortgage and pay the rent on the property I was living in at the time that I could not afford legal advice...so i buried my head in the sand...bad move I know!
Anyhow...in Jan 2010 I received a letter from my mortgage company saying the property had been repossesed and I now owed the shortfall of £90K.
I wrote to the financial ombudsman who then communicated with my mortgage company...they came back to me with their final decision yesterday...that being I was responsible for the £90k, however, they stated in the letter that my solictor needed to obtain certain documents before closing the sale...these documents he could not of received without the house being finished. This meaning it was negligence on my solictors part.
Can I sue the solicitor for this??? ALSO...the solicitor acted for both me and the builder...which apparently is not allowed????
Please somebody help! im in a right pickle!!!!!

If you were getting a mortgage then the solicitor should not have completed the purchase without the appropriate documents. You should be able to sue your solicitor.
Not sure why you completed the purchase if you knew the place wasn't finished.RICHARD WEBSTER
As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.0 -
The solicitor was probably a 'mate' of the property developer - please don't tell me the developer recommended this solicitor to you...."You were only supposed to blow the bl**dy doors off!!"0

ROTFLMAO at 'lack of a dominant male figure'Emergency savings: 4600
0% Credit card: 1965.000 -
Well OP I believe should sue the friend in a civil court and get hold of his Ferrari, house etc for the 90K
Once you have sorted the debt issues and life, I can be happily provide dominant male services as long as you have a dancers body ;-)0 -
Have the summer holidays started yet?0
