I got my response back from FOS I will put what they said :mad:
I would like to confirm that your complaint is not one we are able to deal with.
This is because both citi and metlife(Underwriters, was cumberland) only came covered by our service on 1 dec 2001 and it has been confirmed that we do not have authority to deal with complaints against either businesses that happened befor this date (mine was in feb 2001),
I am sorry that my reply cannot be more positive, my desicision has nothing to do with the merits of your complaint, though it does not affect your rights to take legal action against citi or metlife, if you wish to do so. In pursuing this course of action i reccomend you contact cab for legal advise, this will help you decide whether or not there is any benefit in taking the matter to court.

OMG I am so sorry to hear this, I assumed the underwriter would have been covered, that is so damn annoying.
Maybe the CAB would then be the next best option, and they may suggest small claims court and help you through this.
You could take a copy of the letter you received from the FOS and the CAB should therefore give you some advice on how this works if you want to take it this direction.
Check further details on small claims court first, then if you think you want to give it a go, then get the CAB to help on this one.
It does seem the only way, and I believe there have still been much success this way.
Even though I have never gone this direction myself, it may be ok, but do get advice as stated by the CAB first all free.
I don't think much charges would apply as such, maybe just on success a small percentage, but they should give you the details first, and just to say I would steer clear from claims companies who would charge lots more.

I understand it may not be the direction you want to take, but if other avenues have been exhausted, it could be the only option, unless someone knows of others minus using claims management companies.;)

but think im gonna stop this one unless any one has successfully done it themselves, not finished with citi though credit card charges next woo hoo. Its not as though i havent had any thing back of them 4 out of 5 not bad result really is it. Thanks for all your advise have got welscum do deal with yet so prob need a bit more advise soon:D0 -
