unsafe toy near choked my dog today.advice plz

i bought a 'slammer' dog toy from ebay,advertised as a dog toy so would have thought it would be safe.its a round figure,makes a farty noise when you throw it.it had fluffy hair at the top of the head,like marabou feathers.threw it for psycho dog and he pounced on it and banged it on the floor as jack russells do,prey instinct.i was in the room with him,next thing he starts gagging,choking making horrible noises.the feathery stuff at the top had come off and gone in his mouth,down his throat.managed to pin him down and get most of it out and gave him a drink,he then vomited all over me....nice:o!! contacted the seller and she reckons she has sold loads with no negative comments and they were from an american website selling dog toys.the history on the listing says one sold,which was mine i presume.asked her for contact details as i would like to complain as there is no makers label or packaging with it.ignoring me now.she doesnt sell any other dog items so why bother to sell these?sells clothes and other bits.
anyone have any suggestions?if i had given my dog that toy as i was on my way out,which i sometimes do with new stuff so he doesnt get bored,he could have died.imagine coming home to that,would of been awful.do i have any consumer rights,should there have been a label on it with safety regs,makers details etc?

I can't say about the law but dogs shouldn't be unsupervised with toys (I know you were there but you said normally you wouldn't be), also lots of Dogs can & do destroy toys, mine rips her Hugga Wubba thing to death! It does sound abit strange though with only one showing as sold & the seller saying she's sold loads unless she has a store & people buy from there? Someone will be along soon i'm sure with the legal info x0

Then I wouldnt say they were dog toys. In fact, they were sold in most of the seaside shops a few years ago for £1 and were aimed at kids. The voicebox in them isnt buried enough into the toy for me to consider it suitable for a dog, and I have to say I wouldnt have given it to either of mine with the feather top.
This statement worries me too:

I think your seller happened upon a job lot of seaside crap and decided to sell them as dog toys. They aren't.0 -
when i say i leave him i mean stuff he cant shred,he doesnt usually destroy stuff.just bangs them thinking he was killing them.vet told me to take his toys off him barring one at a time and give him something different when am going out?he's an odd one,some stuff gets battered and some stuff is treated like a baby,carries it round gently and licks it etc.hes had a cow for a couple of years,stinks but he licks it and has it in bed with him.yet those grunty pigs from asda get battered.lol.have got a kong,might just give him that when i go out in future.trouble is he isnt a foody dogShine on you crazy diamond..............0

thats the seller,she reckons she got them from an american website and they have gone bust.hmmmm.i did take the fur off and give him it back.will remove it again!she said she unstitches the back and replaces the batteries for her dogsShine on you crazy diamond..............0 -

Aimed at kids, not animals.
Edited to add. I first saw this in Weston Super-mare, DD was about 4 so its got to be 6, 7 years ago. As I said they were sold in seaside shops, in baskets and even in the grabber machines. Cheaply made stuff really.0 -

have taken it off him,hes got a nice squeaky rat now:D.he only had it for 10 mins and i was here.just emailed her and asked for the label she has cut off to be posted to me or the details emailed.silly bint shouldnt be selling stuff like that.am not normally tempted by stuff like that except in pets at home etc.could kick myself.Shine on you crazy diamond..............0
