At what point does a guest turn into a tenant?

I understand your point, and it is very valid. I am just a bit miffed at your choice of metaphorical example.blackshirtuk wrote: »Would you hire a car and expect to seat 8 instead of 4? , do you not think the police would have something to say!!
I'd expect the car to seat the number of people it has seats for. Like a 2 bedroom property that can easily house 3 people.0 -
""Like a 2 bedroom property that can easily house 3 people. ""
if there are 3 people on the AST - no problem.....0 -
Not acceptable?? What on earth? Clearly this is not her main residence, therefore the landlord shouldn't have any further say in it? If my landlord started having words about my boyfriend I'm sure I'd tell them where to shove it....
She's staying there way more often than a guest.
Why people don;t just live together/get married is beyond me. But I used to have lodgers and if they'd had people staying over more nights than not, I'd have told them to stop. DFW Nerd Club member 023...DFD 9.2.2007 :heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

Hey guys, I appreciate the continued input but none have you have actually turned up any legal definitions, which is what I was looking for.
No matter.the breach of tenancy appears to be that there are more people living in this property than are on the tenancy agreement....
You keep making this point but I'm not sure why?
The way he has behaved falls firmly in the realm of harassment (threatened legal action and said he was going to have someone sit outside and check who goes in and out and when) However I think he is just old/confused and doesn't really get it.
And a couple of points to you wear + tear people.
I am perfectly within my rights to hold a party for 30-50 people more than once a night a week. Surely this would cause as much, or not even more, wear and tear? Besides we fix things like light switches, lampshades, lamps, sofas, shelves etc... cause we're both fairly handy and generally enjoy a bit of DIY
It would be interesting, however, if anyone can find a legal definition of when a guests status changes to 'living' somewhere. Or point us in the direction of any cases where this has happened.0 -
Posters can only go on what you had posted up prior to their response and your initial posts were obtuse.
As you want to prove your own point , why not spend your own time doing the research rather than posting excitedly with immature sexual overtones and expecting others to use their time? Has the school term finished?0 -
""we'll be showing our LL her AST as proof she is not living with us."" - the naiviety of the young.. this proves nothing about where she is living....
tbs - he really does like his obtuse language doesn't he....
""I am perfectly within my rights to hold a party for 30-50 people more than once a night a week."
if a LL thinks there are squatters in his property; or that it is being used as a brothel; or as a Cannabis farm, he is perfectly entitled to gather evidence to prove those things to enable him to put together a court case for eviction...0 -

Forgive me for injecting a modicum of humour. Our landlord is getting snippy about a guest that stays over, claiming that they now live there.
I think that is very straight forward. I state that it is a guest, and the landlord suggests that she now lives with us. Perhaps I should have made the situation, and fact that she doesn't live with us, clearer.
Then I ask for legal definitions.
I turned to MSE because I had exhausted my normal avenues of enquiry.
Clutton and tbs624, your posts are very unhelpful and your continued efforts to belittle me are very strange.
Are you this rude in person, or is the anonymity of the internet allowing you to display your self-righteous nature without fear of reprisal?0 -
you belittle yourself by posting such childish comments about sausages... grow up0

Post on a public Forum and you'll get lots of differing responses. If you can't deal with that it's probably best that you don't post.
Your very own style of posting suggests that there are other "special" internet forums more suited to your angle on life: as Clutton says, you do a mighty fine job of making yourself look small:M.Holloway wrote: »She literally contributes nothing to the house, its bills, its upkeep and wont even give me a swift 'shake' in the showers.M.Holloway wrote: »... she's tucked up in bed sucking on some sexy sausage.
Are you this nauseating in person.? .... I think we can probably guess the answer to that one.
Given your sexual obsessing about their love life , the housemate's GF would do well to hang on to her own place & get her BF/your housemate to stop over there.0 -

The above says it all really. I'm sorry that two of the most knowledgable and helpful posters on this board don't agree with you, but to claim their posts are unhelpful simply demonstrate that you are either unwilling or unable to understand the situation you are in.
Whether there is a legal definition of 'living somewhere' is irrelevent to your situation as a whole. Renting is a two way street. If showing the Landlord the tenancy agreement for the girlfriend sorts out the situation quickly and amicably - just do it and get on with your lives. Starting a petty war isn't going to help you at the end of your fixed term when you are inevitably issued with a S21 and need a reference for another rental.
As for your claim that they're trying to 'belittle' you, with your incredibly disrespectful comments about your housemate's girlfriend, you are doing an excellent job of looking stupid all by yourself.M.Holloway wrote: »

Quite frankly, you need to take this statement onboard yourself and adjust your responses accordingly.
There is a wealth of information in this thread with some useful avenues for you to persue. I suggest you work with your landlord to resolve the situation amicably before starting a pointless 'war' out of self righteousness.0
