Item not as described husband collected what to do next?

            I don't say how it is our mistake, I do not want to scam the seller but neither do I think it is fair to list an item as new in box when clearly it isn't. Surely the seller has to take some responsibility my husband was embarrassed, he had our son with him in the car and did not want an argument. I agree that he should have said something and have learnt from that, but what about the buyers mistakes do we have to take responsibility for those?
Have also found a hole in the net as well.0 - 
            CYberbob, why shouldn't they be able to return an item which is not as described?

            Wow all this advice on how to scam the seller. I'm sure everyone feels great about it. Never new this site was about how to con people.
It was a collection item. Your husband should have checked it when he picked it up. Its not the sellers fault he didn't. If you paid cash you would have no comeback. Just because you paid by paypal and can scam the seller because they were naive doesn't mean you should.
It depends on if you are an honest person and are willing to take responsibility for yours and your husbands mistakes.
As I said, its not black and white is it? Seller will get their holey, filthy not as described net back and OP gets a refund. Seems fair to me.
Its easy to sit in judgement and say what you would do in the situation, but until you are stood on the doorstep collecting the item you just don't know.0 - 
            The buyer can return the item, but to receive their refund from Paypal will have to send it via a trackable means. If they don't they won't get a refund, despite the fact the seller didn't send it via trackable means.
The buyer and seller are to blame imho. The buyer because they should have inspected the item and the seller because clearly an item described as new, should be exactly that. Not something sat out in the weather in the garden.
OP, I don't think you are going to get a partial refund unless you ask.
Your options are to keep it and put it down to experience, send it back via a trackable means and buy a new one, ask for a partial and accept the reply.0 - 
            A trampoline will cost the best part of £20 to return i think. Probably one to chalk upto experience.
Unless you can take it back & get cash off them?
If i was selling a collect only item i wouldnt have taken a paypal payment, Also its then sold as seen.

            Well, we managed to get hold of the seller in the end and she agreed to a full refund.
But now she has relisted as new again although this time it does say there was a small hole in it that has been repaired.
what do you think.

well done! As for the relist, have you left feedback detailing your experience of the transaction? A factually worded neg or neutral would be a good warning to others at this point.0 -

I'm glad you got your money back safely, I see it has now resold so it might be a bit late for your feedback to warn anyone but you still need to do it. The picture is very misleading and obviously not of the item on sale, tsk tsk.
I don't know why some people on here have been saying. in so many words, 'its your own fault' for collecting it. The fault is with the seller for blatantly lying on their listing. Your Husband just did as he was told, as mine would have done too
Also, they seem to be forgetting that you had already paid by paypal, where would you have stood if you had refused it and the seller claimed that you had collected?0 - 
            This is why i pay cash on collection. If its not as described in the listing when i go to collect, i perhaps ask for a portion of the price off or say its not as described and walk away.
If its exactly what was on the listing i pay the kind seller and leave good feedback.2x £5 JD Voucher
