Send it back to the seller via an online trackable means, special delivery or courier. Then ask the seller to refund. If they don't, open a PP case (not Ebay) for SNAD and input the tracking details. You will get your money back, with the exception of the returns postage.
Then put your husband on the naughty step and threaten to sell him on Ebay.0 -

We paid £30 for it, husband had already paid paypal and didn't want a row on the doorstep. Here is the response they sent me
Sorry to hear you are unhappy but i can asure you that the item is brand new we brought this trampoline complete with the safety surround but our children didnt want the net up so it has been in the garden under a pergola for a few weeks as we are in the process of rebuilding a storage shed, as you can see the plastic fittings are still in the sealed bag, yes it might be dirty but unfortunately we have just had recent rain before that it was fairly clean,
we dont have the instructions as never needed them, it is quite simple to attach as the supports just clip on with the brackets.
What my bug bear is that I don't expect to have to clean an item up that is described as brand new and unopened. I certainly wouldn't keep something in the garden if I was selling as new (maybe just me though). Shall I just leave feedback and move on, or would you respond to this message any advise appreciated.
How would you go about asking for a partial refund? or do you think that is asking to much?

I would reply saying you are still not phappy as the item has been mis-sold. It's not brand new and in it's packaging as was listed. As they either don't understand the difference, or don't wish to keep their buyer happy, why not tell them you will be arranging it's return - and do so, with the PP claim as mentioned above. They may come back with the suggestion of a partial refund, or you could suggest that as another option.0

and if I was the seller I'd reply that I didn't see your husband's guide dog, maybe he left it in the car?

Who's to say that the OP's husband saw the listing before he went to collect?
If not, why would he know whether it was meant to be brand new or second hand.
I agree, as the seller I would probably query why this hadn't been flagged at the time, but as far as the OP is concerned, the seller seems disinterested in the fact that their buyer isn't happy, and if they really aren't happy they are qwithin their rights to return it for a refund so long as tracked.0 -
Surely the OP doesn't have to return the item by trackable means? I would have thought that all they need to do is take it back (as they collected it in the first place). If the seller refuses to take the item, just leave it on the doorstep then do a claim through paypal.
This way you're not scamming the seller as they've still got their item. And they can't claim that you've got the item as they have no proof they can give to paypal.
I wouldn't be happy buying a 'brand new boxed item' that needed cleaning because it had been out in the rain. Why was it even out of it's box, and why didn't they have any instructions (whether the seller needed them or not)? I would seriously doubt that the item was new. Maybe it was purchased cheaply as an ex demonstration item?
The seller has been very naive in accepting paypal for a collection item, which is a good thing for you.
However, I would maybe suggest that the next time you sendt your husband to collect something you've purchased, you make him well aware of what it is he's collecting and the condition it should be in. That way you won't put yourself in this position again.0 -
Thanks for all your responses, I agree that maybe husband shouldn't have taken the item but we had already paid by paypal, he had driven 10 miles to collect and didn't want an argument with the seller. I have emailed them to ask to return it and will wait and see what happens.0

Wow all this advice on how to scam the seller. I'm sure everyone feels great about it. Never new this site was about how to con people.
It was a collection item. Your husband should have checked it when he picked it up. Its not the sellers fault he didn't. If you paid cash you would have no comeback. Just because you paid by paypal and can scam the seller because they were naive doesn't mean you should.
It depends on if you are an honest person and are willing to take responsibility for yours and your husbands mistakes.0
