Item not as described husband collected what to do next?

Hi all you friendly ebayers can you offer me some advise. We won an item on Saturday which was collection only my husband collected this evening which was first opportunity the buyer gave us to collect. The item was a trampoline enclosure which was listed as brand new and boxed. My husband collected the item which was in there garden under a tree, not in a box nor was it brand new and my husband queried the amount of clips there were. My husband felt embarrassed and didn't make comment.
I have sent the following message to the seller
Hi My husband has just returned home with this
item and I have to say I am not at all happy to
but it mildly. You listed this item as brand new
and unused and states on ebay that this item is
new is new and boxed. The item is really dirty
and will need to be thoroughly cleaned before we
can use it and that is, if it is all there. There
are no instructions for us to know if the item is
complete and feel we have been very mislead.
Do you think this is very fair what can I expect.

Did you hubby pay cash or paypal. Cash on collection you've got no chance of resolution via Ebay/Paypal.0

Well, the seller has left themselves open to you claiming non-delivery which suggest they are not out and out chancers. As they've no online proof of delivery (obviously) you'd win the dispute. Yep, it's a scam, but you could negotiate with the seller with that in your back pocket.
If you claim Not As Described, you'd only get refunded when YOU return by trackable means which'll cost.0 -
I don't really want to go down that route and surely I wouldn't be able to as I sent the message through ebay? Will wait and see what the seller says. It just annoys me that it clearly wasn't new, was sat in the garden getting filthy and my husband drove 15 miles to get it. Well you live and learn I suppose, just had a few bad ebay experiences lately it puts me off.0

Advising people to scam sellers is not very helpful. There are enough people out there doing it!0 -

Dont get me wrong, I detest a scammer, but I can see that in this case if the seller doesn't play ball with OP claiming INR could be a way forward.
Afterall, in this case OP would return the enclosure to the seller I'm sure.

..next thing we'll have a seller here complaining about being scammed by a buyer who opened a INR on an item they had already collected.

99.999% of those cases are fraud. However, when the seller has the item returned to them they have no cause for complaint do they?
We are not talking of someone collecting a PS3, filing INR never to be seen again. We are talking of a trampoline enclosure that will be returned.
Things are rarely black and white. There is always grey inbetween.0 -
Shouldnt have bought it if you were not happy with the condition.
Puzzled why you would collect it knowing its been used when advertised as new.
