Beneficial Claims now trading as We Fight Any Claim

This company has defrauded me out of £500.00 paid to them as fees for a service I changed my mind about after recieving their terms and conditions by email.

I have been waiting for more than 3 months for the return of my fees I have sent a number of emails and letters and have made numerous phone calls and still to date have not had my money returned. I have written to the Office of Fair Trading and the Serious Fraud office as I am sure that I am not the only one who has been defrauded out of their money by this company.

Martin I don't know if you can help with this but any advice you could give would be welcomed.

  • As I understand it they say they offer a service where refunds of PPI will cover any charges they may make for getting the refund - but they then unexpectedly charge up front and then may or may not - and probably not - get you a PPI refund.

    They may also tell you that using their services for PPI recovery is a prerequisite for applying for a loan, and then they refer you to Wentworth Direct Finance / Yes Loans who charge you £60 or £70 for applying for a loan which you then do not get.
  • They phoned me today asking about any loans I had taken out previously. I told them that I had never taken PPI with any loans and they said I could still have been given PPI without my knowledge. Very strange???
    After giving a few vague details they said there was a good chance I had been mis-sold PPI. By this time I was fed up with this unsolicited call, ready to go out and said I would take advice and get back to them. The guy on the phone said he would transfer me to a senior manager who would quickly tell me how much I could claim. I was finding this all very fishy.
    The senior guy then wanted to run through a lot of the identification process again which I declined and I said leave me a number to call you back on (which I will not be doing). He was trying to tie me down to a date and time so he could call me back. I found this company to be very pushy even after telling them I had always declined PPI when previously asked by banks etc.
    After seeing the comments on here about this company I will be steering well clear.
  • Just had them on the phone, "in reply to a survey you recently completed", and let them go through their spiel.....
    All seemed a bit fishy, but I reluctantly gave them some details. (Credit cards I had, mortgage I was still paying).
    From these meager details, they pulled a magic figure of nearly £5K out the hat, and said I could be 'entitled' to this as a refund from 'hidden' PPI charges...(?!) At the same time, I received an email (I'd just given them my email address) and this contained their fee structure.....
    I was then transferred to an advisor (deal closer) who was very friendly and personable right up to the point he wanted around £475 paid up front. He even went so far as to inform me that his company policy was to advise clients to put this fee on a credit card "which would be fine as long as I kept up the minimum monthly payment".
    It was at this point I interrupted him...
    "You want me to pay you nearly 500 quid over the phone, to a company I've never heard of and put it on my credit card? This phone call is over!" and put the phone down. From what I've read here since putting down that phone, I've had a lucky escape.....
    Just wish I hadn't been dumb enough to give them so much information in the first place. Now they have my home number and my mobile, my home address and my email. Not good.

    Hi, Martin this one is for you. I had a phone call from We fight any claim and just to let you know they are using your name in their speil! So glad I came on here and checked them out, fab site so much info!
  • I have just got off the phone to these people and am sorry to say that I have been duped to the tune of £980. I checked out the internet and I can only find 1 success or positive word to say about them. Most people cancelled and had trouble with getting their money back.

    I do have experience of these types of companies, but 1 that I have allowed to investigate does not ask for an up-front fee and will only send an invoice should any claims be successful (but this now worries me!)

    I have contacted my Credit Card company and explained how and what has happended today and I have to contact them again on 1st April 2011 (I wont be made a fool again). The payment will be shown on my statement but disputed and because of my personal circumstances, the payment will not be awarded to We Fight Any Claim immediately, as is usual.

  • Don't even talk with them. I was one of their victim. I had to try over 2 months to get my refund money back even though I cancelled them within 14 days. They will do anything to get your money and not to refund you. They always say wait for their call back to get refund which they never call.

    I was in touch with my credit card company, Ministry of Justice, Claim Management Regulation, Company of House and Company Investigation Branch (CIB).

    What I did is - I kept all the letters that I sent them (Including cancellation and refund request letter), proof of delivery (as I sent with recorded delivery), and bank statements (to show transaction). And sent all those copy of documents along with their Terms and Conditions copy and cover letter explaining the situation to the above organisation and authorities. I even records the phone conversation when I talk with them cos they always say different things on every time so that I can prove it if I have to go to small claim court (note - I did let them know that I am recording the conversation cos its illegal to record if you don't tell them).

    I got my money back eventually but I am still receiving sale calls from claim and loan companies. I assume that they sell my personal information to similar companies.

    SO what I want to say is don't do anything with them
    If you ve already and paid them - talk with your bank or credit card company asap as they are the one who can re-credit your money. Contact the above organisation and authorities by post include proves and cover letter. The main one to contact is;

  • I have been contacted by Yes Loan company and they transferred the call to another associated payment protection Insurance (PPI) claim company called "We Fight Any Claim (WFAC)". They said I can claim money amount of £1600 from my credit card company as mis-sold. In return, they asked 25% of the claim amount in advanced. They said every penny will refund if the claim is unsuccessful. So I paid £695 over the phone on the 18th of June 2010 as I didn't have much time to think and thought I can trust them (they pushed to pay immediately).

    After that I had a doubt about that company and thought it was too good to be true. So I made a few phone calls to any other companies who provide the same service and did some research about PPI claim over the internet. After phone calls and online research, I no longer believe We Fight Any Claim (WFAC).

    1. Cancellation and refund request made on 18th June 2010 (said – will refund within 30 days) Cancelled the service over the phone and by post on the 18th of June 2010. The cancellation and refund request letter was delivered to WFAC on the 21st June 2010 (sent with recorded delivery, proof available). And I also called them to confirm if they received the cancellation letter. They said "yes, we received the letter. The refund will be made with 30 days". So I wait 30 days and no refund and no response.

    2. 2nd call on 19th July 2010 (Not cancelled yet but told me to wait for the call back within 48 hours)
    So I called them on the 19th of July 2010 and the customer service adviser said "I will now pass your case and information to Case Coordinator who will call you back within 48hours". I did complaint her that why didn’t they carry out these procedure before and why now when I call for refund money after 30 days and she said "There is nothing I can do as it is procedure, you just have to wait for the call back from the Case-Coordinator". So I wait for a week and no call back.

    3. 3rd phone call - No call back so called them again but still persuading not to cancel instead of refunding my money (conversation with “Clise” over 1 hour)
    On the 27th of July 2010 (a week later), I called them again and they say the same thing to wait for the phone called within 48 hours. I mention them that it is what they said last week. The customer service adviser said "there is nothing she can do. She will send email to the the Case-Coordinator". After a few hours, the case coordinator (named Clais) call me back and still persuade me not to cancel instead of refunding my money. I made it clear that I want my money back. The phone conversation took over an hour and I had to finish the call and told him that I gonna have to stop the conversation as there is nothing to talk and will take legal action if you don't refund.

    4. Send letter on the 27th of July 2010 to notify them that they are breaching their own Terms & Conditions, and Financial Service (Distance Marketing) Regulation 2004 for not refunding within 30 days of receiving the cancellation notice, and further legal action will be taken against them if they do not refund in necessary time.

    5. 4th call - They said wait for the Refund-Coordinator to call back with 48 hours (never call back).
    A few days later, I called them again to ask the refund status. They said the Refund-Coordinator will call me back in 48 hours but never call back.

    6. 5th call – Called them back as nobody call back (said refund is on its way)
    I called them again on the 5th of Aug 2010 as the refund coordinator never calls back. And the person from customer care said “the case has been closed and the refund money is on its way so just wait for another 30 days”. So I waited ...

    7. Sent final legal action threaten letter on the 9th of Aug 2010
    Informed them that court invitation letter will be send out on 16th of Aug 2010 if they don’t refund before that date, and reporting to police and other appropriate authorities such as Office of Fair Trading, Claims Regulation and Compliance unit, and Company of House will also be proceeded.

    8. 6th call – nearly another 30 days but still no refund nor respond (said - wait for the phone call again)
    I called them again on 19th of Aug 2010, the customer care assistance said someone tries to call me on the 13th of Aug but I miss the call. But it is not true because I have been expecting their call all time and keep my phone with me all the time. Even if I missed the call, it is their responsibility to try again or leave voice message. It is obvious that they are trying to play around and not to refund the money.
    9. They gave me Refund department ph number to call but the person who need to talk to me is on the phone so they said that person will call me back (wait again..)
    I sent a couple of email to them [EMAIL="assistance@wefightanyclaim.com"]assistance@wefightanyclaim.com[/EMAIL] on the 19th of Aug 2010 saying that I have made several calls and sent several letters to get my refund money, and it is nearly 2 months since I made cancellation and I haven’t received my refund money of £695 yet. They replied me on the same day. In their reply email, they gave me Refund department phone number (01633712759) to call them. So I called them on the 20th of Aug 2010 but the person who needs to talk to me is on the phone. They said that person will call me back. I wait and never call back yet..........

    It is obvious that they don’t want to refund my money and trying to play around. There is always something they blame for. I mean if they want to refund the money they should have done it already. And I don’t understand why do I have to wait for the phone calls from several coordinators from several departments to get my refund money back. It is like waiting for the calls that they never call.

    I also found some forums about WFAC (scam) on the internet saying that customers never get claim money or refund money back from them, We Fight Any Claim (previous name Beneficial Claim). It seems like I was not the only victim.

    Therefore, I reported to appropriate authorities such as Claim Management Regulation about this We Fight Any Claim Company. A few days later, I received a letter from Claim Management Regulation saying that they were in touch with the Director of WFAC and money should be refunded shortly, if not let them (Claim Management Regulation) know. I got my money back finally but still receiving 3 to 4 phone calls every week from loan and claim companies on my phone asking me if I want to do PPI claim or want loan.

    (See my previous post which mention how I got my money back from them. Remember - keep pushing them, tell them you will report, and contact your BANK or CREDIT CARD Company ASAP. KEEP all evident to prove)
