There are 2 approaches here:
1) legalistic. You've had your rights explained; you can 'play the game' and probobly drag out your occupancy for several months or more.
However eventually you will have to leave, so you're going to have to face that 'hassle' sometime.
2) you say "i dont want to mess him about " so why not ignore your 'rights' and be 'nice'. He's made a mistake, and wants you to leave on Sept 13th. What's that? 10 days earlier than the 'rightful' date? And you also say you maybe want him to offer you another property?
I'd start planning to move out on Sept 13th.0 -

At some point you need to tell him both verbally and in writing that he got the dates wrong and that you can stay until the 22nd.
Alternatively you can tell him and give him 9 days less rent but then he may try and muck you around with your deposit.I'm not cynical I'm realistic

Why be confrontational? Why insist on rights just because you have them? Why risk alienating a LL the OP has a good relationship with? Why risk losing the chance of renting another of the LL's properties?0 -

Yes he has options and it's not for us to tell him which to take. Many posters have explained the rights involved. It's now for the OP to choose, not be told what he 'needs' to do.

It is possible to tell your LL that they appear to have made a mistake on their s21 date without being stroppy about it. In all probability is is a typo but this is presumably a "professional" LL as he has other properties, and we all know that you should check that your dates on notices are correct.
A T does not have to simply step away from his legal rights on notice periods just because a LL has hitherto been "good".
Let's hope that the LL can offer the OP/T another property and the T can use the date error as a bargaining tool. If however, he has to look elsewhere for another property he will need the max time possible. LL strictly speaking has to start over with his s21: that's not personal, it's the law for this particular business relationship.0 -
thanks for all the comments, they're greatly appreciated, as i am the 1st of his tennants he's had to evict and i suppose he was as much in the dark as i was, however, he has now told me he will be issuing me another section 21 tommorow with a new leaving date (i'm guessing he's done his homework now). i have no qualms about leaving, i know i have to, and to be fair the rent is killing me at the moment so the option of moving to a cheaper house is very tempting,
when i said i dont want hassle, i meant as in moving house, it's not the easiest thing in the world to do is it?
so even though he's issuing me with a new S21 tomorrow, does that still give me til the 22nd sept to find somewhere else?
