there has NEVER been a set number of nights that you can stay over - technically, if you spend one night together then you don't qualify for benefits for that period, however, it is much more complicated than that which is how the urban myth arose in the first place.0

It is not irrelevant, as you have demonstrated in your list of factors (whilst not the same situation, Fitzpatrick could be persuasive authority). You do not make the decision as to whether you are genuinely living apart, the LA/ JCP do.
