There are no set nights, it's at their discretion!

Are you working, or would you have to go on IS?

there has NEVER been a set number of nights that you can stay over - technically, if you spend one night together then you don't qualify for benefits for that period, however, it is much more complicated than that which is how the urban myth arose in the first place.

With all respect it is pretty unhelpful because it is wrong.

In your opinion as I ACTUALLY live in the way this lady is talking about and the LA are more than happy with our living arrangements

No, not in my opinion. The fact is that several factors are taken into account, not just the amount of nights spent together.

I said your information was wrong, which it was. I did not need to elaborate, several people (including myself) already had.

Best to read the contents of the thread before posting - there are many knowledgeable people here, and it's never helpful to give bad information!

Fitzpatrick v Sterling Housing Association LTD is case law pertaining to tenancy rights, it is irrelevant to benefits.

I think you will find thats incorrect. It is also the leading case on determining cohabitation for benefit purposes.

It is not irrelevant, as you have demonstrated in your list of factors (whilst not the same situation, Fitzpatrick could be persuasive authority). You do not make the decision as to whether you are genuinely living apart, the LA/ JCP do.

Yes, and as noted above I have already spoke to both x
